can he take my kids from me?

im 21 and im legally married and been married for like 5 years.my husband is plotting to save money and get lawyer and take my kids from me...ive never worked but one day and quit.because got home and child wasn't taken care of correctly.so then never went back to school because he didn't want to pay a daycare so i watched my kids and same for job people wouldn't hire me because i was so demanding in hours so it make s it harder and again couldn't go full time cause he didn't want to pay daycare.we dont have our own place we live with my mother and aunt that has a boyfriend and 18 year old .so i need someone help what do i do so i can get custody of my kids

No, he cannot take your kids away from you it will take a lot more than what you have written on here for that to happen and if he says he is going to, it won't. The most he can do is get legal visitation through the courts he cannot get full custody of the kids just because you have not held a job. If you two ever end up in court the judge might order you to either get a full, part-time job or enroll in school. Also there is state assistance that you may want to look into that helps provided financial help for working families if he is not helping.

No judge in their right mind would give children to people who didn't show that they were stable financially, mentally, and emotionally, so if your husband shows judges that he is doing a better job than you are as a parent, then he would probably give them to him, but if you were to act more dominant and responsible then your kids would probably be with you, since your married you both have equal custody rights, and then it has to be settled in family court, what you should do is try and work towards getting place of your own, getting a full time job with benefits, and looking for cheap day care or during the summer their are usually summer camps in the community that can work around parents hours, or Churches even have day care for people who can't afford it but have to go to work, but make sure you prove to people that you can be a good mother, and if the Judge thinks that neither of you should get them, your mother could get custody or they would be put into the foster care system.

first of all he can't just take your kids -
the court determines who is best suited to have custody - and that is done based on historical care of the children (who provided the care) - ability to provide etc.....
they will also - if the kids are old enough - ask them what they prefer -
if he leaves - do not let him take the kids - CALL the POLICE - period end of story
if he no longer lives there - and comes and wants to take the kids - CALL THE POLICE - period end of story
you will undoubtedly need a lawyer if you can't agree on this

You have been the children's primary caregiver their whole lives. Unless he can prove you are an unfit parent, it is unlikely he will be granted full custody.

Can you prove that you quit work at his request so you could be a full time stay at home mom and raise the children?
