A question about event oriented counseling?

I am a specialist in a squad leader position in my platoon due to the fact that our unit is undermanned, seeing as we're just being stood up. One of my soldiers was pulled over for speeding off post and not wearing a seat belt, and when he informed the chain of command, I was instructed to counsel him and to direct him to perform corrective training. When I wrote the counseling statement, I failed to include the specifics of the corrective training (an essay and holding a "Click it or Ticket" sign in front of the company during the work day for 2 hours). He now argues that he does not have to perform the corrective training, seeing as the counseling statement has already been signed and I did not include the specifics of the corrective training. Is this the case?

I can see where he is coming from, but my NCO insists that he still has to perform the training... Help!

Call him back in and start a new counseling session. Tell him that you gave him wide latitude in choosing the additional corrective training but he has obviously not taken the hint. Since he has dishonorably chosen to ignore your instructions you are now forced to make it more specific. Then direct the additional training for the original incident.

Now you should also direct further training on taking initiative when given the opportunity to do so, as well as following the spirit as well as the letter of the orders issued by those in positions of authority over him.

Your NCO will be looking for both of these items to be addressed. If you don't, you'll probably find yourself on the short end of a leadership counseling session yourself.

Don't know how it goes in the AF, but why dont you use your chain of command. Let your NCO know that your soldier flat out refuses to do what he is commanded to do, due to the fact it wasn't in his counseling statement..see how much he argues with someone over your head... I don't think he would want an article 15.

Can you do an addendum including the corrective training?

I'm assuming you outrank him? Even if you don't you have positional authority.

Break out AR 600-20 and show him where it says that you have the power to give him orders.

I would recommend wriitng up a memorandum for record showing what the corrective training was, and why it was not included on the counseling.

But let that be a lesson to you, no to screw up the counselings again.

You do have the power to have him do those things. It's all in the regs.

If this guy is being a pain in the butt, re-do the event oriented counseling form, even stating in there that this one is being done as an addendum to the first, and put in all the corrective training. ANd yes, the guy still has to do the training.

hmmm, this is a good point. normally you include the corrective training on the back page.

then again, if you instruct him to do it and he disagrees, you could write him up for disrespect. when you write the "disrespect" counseling, make sure to include the corrective training. that way you've got all your bases covered.

or you could just destroy the counseling your wrote and give him a new one. it's not going to hurt. i'm 100% positive your platoon sergeant and first sergeant would understand. he's just a douche bag for trying to tell you otherwise.

I would tell him to stop being a Jacka**, redo the counseling and use the back side under lan of action to input the counseling. The 4856 is just a written record of the counseling given and can be amended and redone at any time. He is confusing double jeopardy with the issue. Can't give corrective training and then go redo the counseling and add things that were not previously discussed, like redoing it and adding UCMJ action is being recommended. If he still gives issues over it, then he can be given an on the spot inspection of himself and of his entire TA 50 to include initial issue, to be followed with a health and welfare of his living area's and an indepth POV inspection. If he still gives issues then smoke the dog sh^t out of him :D
