We all swore an oath to protect and defend the Constitution of the United States against all enemies, foreign and domestic. Would you refuse to obey an unlawful order that was in contravention of the U.S. Constitution?

Expanded Explanation: Look at history...U.K., Australia, Nazi Germany: First register firearms, then confiscate arms in the hands of the civilian population. The 2nd Amendment keeps our Government in check. With an all volunteer military, we are an order from the CIC from a Socialist Dictatorship. Don't try and read anything else into the question about militias, or unlawful acts. Simply an order without any probable cause, to disarm the American public. Would you comply with such an unlawful order in violation of the Constitution you swore to protect and defend? Forget the traditional and lawful separation between military and civil authority. Oh, and given what is happening in our country, the question makes a lot of sense. Thanks

The US military is barred from civilian law enforcement activities.
The only case in which such an order would conceivably be issued is in a case of martial law, where the possession or use of weapons might be a risk to public order or to the troops themselves. Even then I doubt you would get such a sweeping order. Well, come to think of it I am quite sure this was done during the Civil War in many cases.
On the other hand, the answer is YES as to what they do in Iraq, the 2nd amendment being inapplicable there.
Now, can you cite even one case where such an order has ever been issued other than during insurrection? Is there a good faith basis for this question or are you just trolling? |

You're asking for a black and white answer to a very gray area question. If you are using that weapon for illegal purposes, then you no longer have that right to have the weapon.
However, the active duty military is not a national law enforcement entity. That falls under the Department of Justice, not the Department of Defense, so your question is unrealistic and irrelevant.
Edit: The only reason martial law would be declared in the forseeable future would be to get that socialist moron out of the White House before he ruins our economy and our national security even more. |

This question is too broad. Why would we confiscate civilian weapons?The only reason would be to stop an illegal arms dealer in the US. Then they are in violation of other laws, and law enforcement handle those kinds of things. Now hypothetically if martial law was declared it would be in the line of duty to confiscate militia weapons or what not. This question doesn't make sense. |
