I have been in the Army for 8 years. I have done 3 Iraq deployments. What I remember is if you plead "Conscientious Objector" Status. I believe you might be able to not go, but you still have to stay in the Army and work at your base. But most of the time I don't think it really matters to get that status because, you might still be order to go and you can not disobey orders. No you will not be executed on the spot for disobeying orders; you might go to jail though. But the Army is not in the business of executing its soldiers. |

Well, they can refuse, but the consequences are jail, and when your jail term is up, probably dishonorable discharge (which would include loosing your veterans benefits). |

Once you have volunteered to be in the US military you are obliged to go where ever they send you. |

They are obliged to go where ever they are assigned to go.. they cannot pick and choose. |

Yes, they can refuse to go. They can opt for reassignment to cushy jobs in places like Fort Leavenworth, KS making big rocks into little rocks for a couple of decades. |

Of course they can refuse... they get tossed in jail or something else, so there's going to be consequences, but they can refuse if they so choose. |

This is a volenteer military, if you dont want to go to war dont join the military. For those that didnt study the papers, when you sign you are giving up your rights under the constitution an are now subject to the UCMJ code of conduct. IT states you are goverment property and in such you are subject to a lawful orders. If you dont follow them in times of war it did state the max punishment is death by the hand of your co. |

If a soldier refuses to obey such an order it is considered breach of contract and the soldier is punished, usually involving prison time and dishonorable discharge. |

Yes they can and then be charged with disobidience with lawful orders, missing movement, cowardiance, and any other charges the military can decide to use and be court martialed right after that. So if you are asking if they can say Not going and nothing happen to them the answer is no; if they want to go to prison and have a felony convinction in their record plus a less then honorable discharge then they can say they aren't going if they want too and are wiling to pay the price. |
