Can a spouse stay at the duty station her husband is PCSing from?

The neighbor next door's husband PCSed to a new duty station. She and her children have been staying next door in housing for 10 months. However she does plan to move after July. My husband has orders to PCS in August. I asked could we get report date extended to January they said, No. Which I know is possible. Then I asked if I could stay on post housing until January when I finish my degree and training and they said No, again. Is this based on rank? My husband is an E3. Her husband E6. Anyone know a regulation on this or how it works? Thanks for all of the feedback.

The only way that a family can stay behind in military housing, is if the service member went to a hardship duty spot (i.e. Korea, Honduras, etc). |

The only reason they could have stayed is if he was on TAD/TDY orders for schooling or deployed or on unaccompanied orders to a place like Korea, Diego Garcia and they requested to stay. So technically he is still at that zip code until he reports to the new command. It has nothing to do with rank at all, it depends on the orders. If your spouse is PCSing without TAD/TDY orders you must vacate housing. |

You can stay in housing only if your spouse in PCSing to a dependent restricted tour (i.e. 1 year in Korea). Its not based on rank, but the assignment your spouse is going to. |

You would have to give a good reason to the housing office for why you want to stay in post housing. You wanting to extend for college isn't considered a good reason to the Army since in their eyes you can transfer to another school and if you choose not to transfer there is nothing stopping you from staying behind. In some rare cases, they will allow you to stay in post housing, such as if your husband PCSed to Korea (which is probably where that other spouse's husband went). If you can't convince housing to let you stay and you want to stay for school anyway then your best bet is to get a cheap apartment off-post with a short lease. |

there are MANY scenarios that would explain why she was permitted to stay in housing after he left.. Unaccompanied orders, Training en route to the new duty station. EFMP and no housing at his new duty station.
Rank has nothing to do with it. maybe when they asked and got permission there was room in the waiting list and they didn't need the unit immediately. Now maybe demand/need is higher and they do need the unit right away. maybe your unit is scheduled for renovation in the near future.
if your DH's new command needs him in August he has to report. period. you can always move out and get a small apartment to finish out the school year if they will not permit you to stay in housing. |

As you see the higher the rank the better the chances of you getting on base housing. Which is usally assigned first come first served with rank as the main determening factor. |
