If they really really like each other then the answer is still NO.
It doesn't matter if you are state side or deployed because that situation can change in a matter of weeks. |

According to the UCMJ the answer is no...enlisted and officers are not supposed to socialize (they use the word fraternize) in any way...including dating. However, the reality is that as long as the offficer is not in the enlisted's direct chain of command, preferably not even in the same unit, they keep the relationship discreet and the enlisted does not attend official functions as the officer's date, many units will look the other way. However, if the relationship develops to the point of marriage, many times the enlisted will opt to leave the military since at that point there will be no way to keep that person seperate from the social life of the officer. All of this can depend on your command..some are more hard line than others. And, during deployments, any intimate relationship is against regs...be it with another enlisted or with an officer. |

according to the manual for courts-martial, chap. IV-section 83, artricle 134, this relartionship is called fraternization. the elements of such is 1) that the accused was a commissioned or warrant officer, 2) that the accused fraternized on terms of military equality with one or more enlisted members in a certain manner, 3) the accused then knew the person to be an enlisted member, et. al. the gist of this is that general contact is okay as long as its part of routine daily activities. if this progresses to a relationship then the answer is a big fat no. they cannot date for any reason at all. the only exception to this is that the enlisted member is active duty and then the other joins as an officer. they are allowed to be in that relationship with no reservations. anything else is against the ucmj and mcm. |

While UCMJ is the same for all services, policy enforcement is handled differently by each of the services, especially in the area of fraternization.
Since I'm in the Army, I will only speak of what I am sure of....
In the Army, officers and enlisted cannot date each other... PERIOD.

Not if the Officer is in the Enlisted's chain of command. Or anywhere that he could be in a position of authority to that particular enlisted personnel. Fraternization will get you into a lot of trouble. |

No, they can not date. it is against regulations. Fraternization is what it is called and they will fry you both for it when you are caught. good luck |

As long as there is no conflict of interest involved. For example, if the officer was in the enlisted's chain of command it would be improper and not allowed. Also, instructor/student would be another situation where a relationship would not be allowed.
When I was stationed in Germany, a captain got an E-4 pregnant. There was a big hubbub about it, since the captain was a staff officer and the E-4 worked in his office. I remember she got an article 15 (eventually getting a discharge and marrying the captain), don't remember what happened to him. |

yeah why not?!are you serious lol there are rules about things like that and its called fraternization.. the only way that you can get around something like that is if the officer has no direct authority over the enlisted person (i.e. platoon leader, xo, c.o.) because if you think about it that officer could have infulence to get you special treatment or even to have you treated like sh!t if something goes wrong.. either way that whole thing is not a good idea. go ask the sgtmajor that question and see what he says to you.. |

They can date each other as long as it doesn't create a conflict of interest. They cannot marry however unless one resigns.
These type of relationships are not encouraged but they are legal. |
