Can you file a restraining order against someone who is in the army?

first of all, how do you go about doing it when they are in the army? and how do i notify his chain of command that i have a restraining order against him?

he screwed up big time..well heres the story.
i started seeing him about 5 months ago, and come to find out he is married, and also had another gf, and iam 5 wks pregnant and his other gf (well ex) is 5 months pregnant by him...and this all blew up in his face and he keeps telling me that i should get an abortion so that will solve all his problems and so the army wont find out. hes calling me non- stop, texting too. I got my phone bill today and within the past week i have gotten over a 100 calls from him. its ridiculous. and I know he can get into trouble with the army for everything.

Same as filing a restraining order against anyone else. Go to court, get the order.... just because he's in the army, doesn't change your due process. His command will receive notice from the court, you don't have to worry about that.

I would think that you should go through you local police. A judge will approve or disapprove a restraining order. The civilian judge should notify his chain of command. If this is a PFA (protection from abuse) he will not be able to handle arms and he will be non-depolyable. It is a big deal. Definitely file one is this person is being abusive, but do not if this if it is just a get even tactic. Good luck.

EDIT: I just read your additional information and I say get the restraining order.

You could try to get a restraining order, but based on the information you posted above it doesn't seem like he's done anything more than merely get on your nerves. (If you really want a restraining order I'd just tell them that you are concerned with the safety of your unborn child... that is if you plan on keeping it.) Changing your number would eliminate him calling/texting you 24/7, but if he knows where you live next thing you know he could be on your door step wanting to know what's going, why you changed your number, etc. which could just lead to even more problems.

By the way, here's some questions to ask yourself if you're ever in a relationship again and you have a feeling that something isn't right and that Mr. Tall, Dark, and Handsome might be involved with another woman, engaged, or married.

For starters, has he introduced you to his friends or family yet? If you've broached the subject and he doesn't want you to meet them, it may be because he doesn't want anyone to know that he has a girlfriend on the side. In some cases, the whole family may be the cheating kind, or might not like his wife, and therefore would not be concerned that he was seeing someone else. If you find yourself in this situation, turn and run away as fast as you can.

Are you able to just drop by his house unexpected? Are you able to call him at home? Does he make up excuses to get off the phone when you do call? If he lays down any unusual rules about visits or calls, you might want to test those rules at least once. Find a good reason to call him anyway, just to make sure there isn't a wife there to answer the phone. It should definitely be noted though, that if you're worried about your boyfriend being married, while you should find out for sure, you don't want to ruin a good relationship because you were too untrusting.

Communication is the key, and trust goes both ways. If you keep the lines of communication open, you have a much better chance of having an honest relationship.

You don't need to notify his chain of command - you just need to have him notified, which will be done, most likely, by the court.

It works the same for military personnel as it does anyone else, call your local clerk of the court and ask for the necessary papers, then convince a judge that you need the restraining order.
