Can you say those Soldiers are a murderers?
Find answers to your legal question.

Can you say those Soldiers are a murderers?

if you are in the army in a war against a country and to be exact not defending your country there is some differents between those two points

will not those who are fighting this specific country considered to be murderers?

for example a U.S soldier in Iraq is he a murderer?
if no why?
Additional Details
me my self if my country ask me to go on a war against a country i would not go

a war today is not a soldier fighting a soldier after the Worlds War 2 this have change

why would i not go because i will have to much on my consciences i would see the baby that was killd in this war and i would feel responsible because i have been part of this war

so yes if i join the army and go on war against another country i am a MURDERER!

If you kill, maim, or torture unarmed civilians during a war you are guilty of war crimes. You could argue that no war was formally declared.... In that case you are just the plain kind of murderer. Either way killing civilians is a no go. Sure, the air strikes during the "shock and awe" phase of the war (remember then?) killed thousands of civilians, but that doesn't make anybody murderers. Or war criminals. Should one of the bomber planes have strayed off course and hit a building, killing thousands, then maybe, but as long as it's just the bombs we're dropping killing the civilians, we're in the clear. Not sure why. But I'm told we are.

Ya know, nothing surprises me on here anymore.

Murder is the unlawful taking of human life with malice aforethought. Soldiers acting under the rules of engagement are not acting unlawfully or maliciously. The righteousness of the war is irrellevant if he is acting under orders.

If the leader of the country or a general officer orders an action that violates the laws and customs of war, then he may be found to be a war criminal. That is why Bush renounced the World Court. He is evidently not certain that all of his actions conform to international law.

Well, that was some rant there. However, a soldier is doing what his government told him to.

war is killing..... soldiers in combat are just doing that killing, not murder, there is a difference!

Your sick in the head, little pip squeaks like you would never say some crap like this to a soldier!!

If you did then I bet they would be murderers!!

Texas Longhorn
Of course not. He is simply doing what he was commanded to do by his boss. The Bible tells us to render unto Caesar what is Caesar's, right? Therefore, we must do what is asked of us by our government leader, right? Besides, in fairness we have found several members of Al-Quaeda in Iraq, but I don't support the war.

When you kill for selfish reasons it's called murder and is a crime. When the enemy engages you in combat it's self defense and legal. Our troops would love it if the enemy surrendered with out a shot being fired but the enemy is stupid and must be killed.

"if we look into Vietnam war there is many videos you can see Soldier executing kids etc...."

What is your source for this; what videos are you talking about here???

Do individual soldiers do bad things and go too far? Yes, it has been know to happen, is it right? No, it is then a violation of U.S. Federal and International law. Any member of the military as long as he or she acts within the limits of their orders and the instructions given to them by their lawfully appointed commanders cannot commit an unlawful act. Nobody can order you to commit what you know to be unlawful act such as murder.

Your augment doesn't hold water!

No, he is only carrying out what his government ordered him to do. He is only serving his country and protecting the freedoms of everyone in it reguardless of how well he likes or dislikes or even knows them. Military members do things that most people cant or wont imagine.

If you enjoyed your freedom today, Thank a Veteran.

Hmmm... I don't think you really wanted anyone to answer this question. You said "if no, why?" I think you should have warned that you would be shoving your opinion down anyones throat that disagreed with you...

NO... They are not murderers. They are doing their job, they are defending their country AND themselves. They don't run around shooting innocent civilians for absolutely NO reason. You enjoy your freedoms? They were fought for not defended... Wow. Have you ever seen Carlos Mencia? Do you know the expression "Dee dee dee!"? Well, that definitely applies here... Have a nice day.

Since you are not from the United States and apparently cannot write English that well I will go easy on you and try to explain. But first I think what you are saying is that killing for your country even though you don't believe in its cause is wrong. What I will try to explain to you is that a solider is a person that protects their country by the will of the people the solider is so directed by their government to do so. At least here in the US it suppose to work that way. The solider job is not to debate politics but to act in according with the will of the people(government). Now to the point in hand. Most soliders are not murders, most only kill to defend themselves and/or their brothers in arms. Of course there are a few bad apples in every bunch just look at AG. But by in large a solider that is on the front lines looks to take out the enemy. Not women nor children. Sometimes though innocent people are caught in the cross fire which is sad but it happens. Our soliders go to great lenghts not to harm the innocent and even at their own prerail they hold back to insure the innocent are not harmed. I could go on with this but I am not sure you will fully understand. But I'll leave you the definations to think about.

Murder is the unlawful killing of a human person with malice aforethought, as defined in Common Law countries. Murder is generally distinguished from other forms of homicide by the elements of malice aforethought and the lack of lawful justification. All jurisdictions, ancient and modern, consider it a most serious crime and most impose severe penalty on its commission.

To kill, killing or to have killed means to cause the death of a living organism. The act of killing an animal, plant, or other life form can be said to have occurred when an outside force, usually another life form, has done something to cause it to die. This may be a result of several actions:
a deliberate action such as war
in the case of animals, slaughter; see slaughterhouse
the result of a criminal act, the action or fault of another human being, see homicide and murder
the results of an accident, such as a car crash. See negligent homicide
an organism eating or otherwise ingesting another organism

No, as long as the Laws of Armed Conflict (LOAC) are adhered then technically they would not be, However if they shot a civilian or unarmed combatant this would be against the LOAC and there fore they could be tried for murder. This is obviously a very brief insight into it gets a lot more technical as the LOAC includes the United Nations Charter, the Geneva Conventions and the Hague convention.

By searching any of these or the LOAC in Google there is a lot more detail !!

A soldier never commits murder if he conforms with the laws
of war;don't forget that he puts his own life in the balance and for that there is no difference if the war is aggressive or defensive;
now, violations of the laws of war constitute a crime whether you
are defending or you are the aggressor(example:shooting of prisoners...)
