Could McCrystal be court-martialed?

First, he publicly criticizes his Commander-in-Chief. Promoting dissension in the ranks?
Next, he requests a resignation. Isn’t that akin to deserting your troops? A foot soldier who wants out will face a dishonorable discharge or other discipline.
Didn’t they use to hang officers for such offenses?
Obama still praises him for his service.
Will he get to keep his pension?
I have no ill will for McCrystal, but aren’t officers required to follow protocol?

Jeeper, you make good points. What's frustrating about this event is that news agencies aren't giving any facts from the Stones article. I haven't read the article, but evidently McChrystal is critisizing the President and his administration. And the fact that he wants to resign, shows his lack of confidence.

Article 88 states, “any commissioned officer who uses contemptuous words against the President, the Vice President, the Secretary of Defense, the secretary of a military department, the Secretary of Transportation, or the governor or legislature of any state, territory, commonwealth, or possession in which he is on duty or present shall be punished as a court-martial may direct.”

Yes, he clearly broke a Military Justice Code. I don't think any of that other stuff will be brought against him though. Obama claimed that he was a good soldier and I think he just to continue with the war policy and get past this incident.

He could but I don't think Obama or anyone else is going to pursue this. He made a mistake, and he took the most honorable route. Petraeus is more than qualified to make the transition.

What exact criticism of Obama did he make ?

Have you read the article ?

He criticized the Ambassador to Afghanistan , he never criticized Obama.

Now unnamed members of his Staff criticized alot of people.

But you cannot court martial someone, for what his staff said.

2. Resignation is deserting your soldiers ? Then evidently you think every enlisted and officer should serve in the military to they are forced to retire. People leave the military all the time.

3. A dishonorable discharge is given when convicted of a court martial for a serious crime, IE: rape, murder, etc.

4. Of course he will kep his pension, he has served in the Army for 37 years, he damn well earned that pension.

I just wish he had the cajones to not apologize. That , to me , showed more weakness than whatever he allegedly said in the first place. Guess I am just old fashioned and not at all politically correct.
