Does FMLA apply in the navy?

i am having major knee reconstruction surgery and i really need my hubby to be home for a week or 2 to take care of me and my baby and he is TAD right now and cant take leave for 120 days but i dont know if this would be and exception or not... plus he only works 2 to 3 days a week so its not like he will be missing alot of work and he works nights in cargo when no one is really there and they get to sleep for like 6 hours while they are at work, so its not like they really have to have him

No, he can not use the FMLA as a reason to get leave for the your surgery.
He will have to run a leave chit, since he does not have any leave and because he is TAD it will be up to his command if it granted.
The Military allows "emergency leave" it is still leave and he will go negative or in the hole since his leave balance is currently 0.
Please be aware that anyone that uses the FMLA, does not still get paid, which the military does not "stop" pay.

You either need to find someone to come help you out, since its only two or three days a week, maybe look into the Child Development Centers and ask about Drop Off Care or he needs to run a leave chit and see what happens, or reschedule your surgery.

FMLA doesn't apply to military members. Your husband will need to put in for leave to be with you. It is up to his command to grant it or not. Now, most commands will do what they can when family emergencies arise, but there have been cases where they wouldn't approve it. The truth is, with the military duty will always come first. All he can do is put in for the leave (assuming he has enough days accumulated) and go from there.

Assuming you mean Family Medical Leave Act then No - that is for the family members of military personnel to be able take leave, not the military members themselves.
