Find answers to your legal question.

Does anyone know a way to get help from a military husband in the reserves?

my sister in laws husband is in the reserves which we just found out yesterday because he lied about going active. he came home took all her savings and her debit card to his account which he also lied about. he told her it was joint. then we called usaa and they told us he had never even requested to make it a joint account. so is there a way she can get help because he left her to take care of 2 kids with no money, and refuses to help her if he doesnt think what she's asking for sounds right. so whos the best person to call to help her?

Since he is in the reserves,

She is going to have to go thru the civilian court system.

If he was active duty, his commander could help.

But being a reservist, there is nothing his commander can do.

local courts. Once a civil judgement has been made, the military can then attach his wages.

Yes, call the service he is in and make them aware of what he's done and that he has a family "in need." They DO NOT take kindly to one of their own leaving people in this condition, it makes them "look bad" and his superior officers should bust his *ss and make sure he takes care of them. If necessary, get a lawyer to make the call, as it would sound more sincere and less like an "angry wife" out for revenge. Good luck! Write letters if you have to, but make his superiors aware, especially those in the region he signed up in.

There are also "Wives Organizations" in different services that aid wives 'left behind' when the husband goes into the service. Also, she needs to sign up for State and Federal help (that's what its there for, those in need) and THEY will track him down if they feel he needs to help.

I don't think the military can help unless he is an "activated" reservist serving full time in the military. Social services may be able to help track him down, but I think its more of a matter of changing things into her name only, and using the state system to get help. I think what he did is abandonment, but I am not a lawyer. It would not hurt to let his reserve unit know what his actions are though. The military really does not stand for a whole lot of that kind of action. Good Luck

HE's IN THE RESERVES PEOPLE!!!

Bill H has it right. Go through your civilian courts. Child welfare may lend a hand also but keep in mind that if they're still married, her options are limited.

If you know his command then go through his command. They will punish him for that and she will get money from him. If you don't know the command contact Military Police authorities or go speak with the reserve recruiter so you can get his info. because they do have ways to look them up and can contact the command.

I suggest going to your local child support office and file a child support order against him.

She needs to contact a lawyer first thing to initiate child support. Any time that he is on active duty she is entitled to his BAH at a minimum as far as the Army is concerned. She should contact his Reserve unit's Unit Administrator. They can give her guidance and assist her with the process of collecting funds from this Soldier. Good luck to your sister and her family, sorry to hear about the situation.

Is he active or not? If he has gone active you can report him to his commander. If he hasn't gone active, she can apply for emergency legal assistance and make him pay child support. The local attorney generals office in some states can usually take care of that. AFDC is another agency that will help her track him in some cases.

Call the first Sgt. of his squadron, They will take care of it from there. If he is not providing fro his family they will bust his ***.

Go to AGI (Adagent General Inspector) or his Company Comander.

If he is only in the reserves he only gets paid to drill on the weekends unless he has been activated and deployed somewhere. If that is the case he by military regulation is required to put a roof over your head and pay a certain percentage of his pay to you. The number has changed but it is at least one third and the more kids you have that are legally his, the more he has to pay. IF you know where he is or what command he is attached to you may contact them since you are not divorced or legally separated base on what you wrote. Your best bet is to get a lawyer, file for abandonment and get his wages attached for child support. You can only do that through the civil court thought. Military JAG officers do not touch domestic family cases like this one. If all those accounts were never joint, you never had any right to them even if you were married.

Oh man! I'm sorry to hear about your sister in law. Do you know what reserve unit he belongs to? Find a lawyer and tell them exactly what you said here, it shouldn't take long to get him tracked down.

In the meantime, call the reserve center and ask to speak to his commanding officer, they should be able to put you in touch with the ombudsman who will then help you get directed.

a lawyer. this is strictly a civilian matter. the military will not get involved without a court order.

Fireball226
she can call the post where he is stationed and ask for his commanding officer...then explain..

simarik757
Call his command or the relief society. They will make sure he takes care of his obligations.

hanibal turkey
call jag your sis needs legal action and she needs to contact her nearest jag official because he is in the reservs jag is free to military and there family

Ozzie1969
The first step would be to contact his Company Commander or Company Chaplain.
2nd step would be to get in touch with the JAG office.
