How do I terminate my lease to move in military housing with my husband?

I've recently signed a lease for an apartment in Chicago. The reason I did this is because my husband is in the military and he was given orders to train in Wisconsin, then report to Peru. We were temporarily renting a room in a house in Georgia (where he is stationed) until we recieved housing. When he recieved the orders I decided to get the BAH and move back to Chicago, where my family is, until he returned, then we would get the housing on post. Now his orders have changed and he is to stay in Georgia until December, the lease here for Chicago is until May, so am I allowed to forgo the lease to move back to Georgia for housing on base? What is the law for this? Sorry if this has alot of run-on sentences, I'm really anxious about this matter. Thanks!

I'm the only one on the lease but the landlord used his checkstubs to approve me moving in. Also, she did no credit check.

Suggest you have your hubby take a copy of the lease agreement to the Legal Assistance Office on post. It's a free visit. They can look it over and let you know if there's a military clause or provision under the Soldier's and Sailor's Act that might apply.

I tell you this because I really think it depends on the lease you signed and the condition of the agreement. Something this important is a question for the legal office to answer.

Explain the situation to the leasing company and see what they say. Under law, military personnel have to be let out of their lease if they are transferred. I'm not sure if it would be applicable if you signed the lease on your own, but they may be flexible if you give them adequate notice.

no. since you are the only person on the lease you cannot get out of it to move into MFH.. PLUS most leases that have a military clause only covers PCS moves, NOT to move into base housing,

I doubt you will be able to get out of the lease. You should have your husband check the availability of base housing before making plans. Most base housing currently has waiting lists.
