I am being investigated for suspicion of distribution and consumption of controlled substances, my CO has flagged me and I am being restricted to post. When I spoke to CID they told me they have statements on me from people stating I have committed the crime they are trying to charge me for. I HAVE NOT DONE ANYTHING WRONG.... The several surprise urinalysis that I have passed proves that I haven't done any drugs.
My questions are; How long can this go on for? I am basically being charged without even stepping in court, I am not allowed to do anything what so ever such as go off post, a lot of people and I feel this is unjust do to the fact that I haven't done anything wrong and that they are taking this to an extreme extent by taking my liberties away from me. I can't get promoted, and is affecting my military career dramatically...
What can I do to get off the flag? What can I do to help my situation? What can I do positive for my situation? What can I do to get my liberties back? Anything positive that can help me would be great; such as regulations...
Please, please anybody that knows military regulations really well, if you have anything that would help me in any way.. please help me out..

The statements are from people that failed urinalysis and are currently in the process of getting chaptered.

Welcome to the military. Where basically they own you and can screw you over however they want.
They can treat you like that for the rest of your enlistment if they want to. Or longer if you end up getting court-martialed and convicted.
I would strongly suggest you go to JAG and get more case-specific advice there. Also due to the seriousness of the investigation you may want to look into hiring a civilian attorney who specializes in military law. |

well if you havent done anything wrong i would request to talk to the company commander directly and tell him this is affecting your ability to be a 100% effective soldier and if doesnt end ask for a discharge and go on sick call and ask to see a shrink this is only if you have done nothing wrong |

You need to get over to the JAG office. Until you have been formally charged, you should not be on restriction. Request to see the IG about the flag. You should have been formally charged and have had your rights explained to you (including the right to legal counsel) before being restricted. |

Perhaps you were hanging around the wrong kind of people (civilians & military drug users, distributors, etc...)
that alone is enough for the CID to start asking questions!!!!

All of this is an inconvenience to them as well. I'm sure they have good reason and aren't doing this for the heck of it. Haven't you ever heard of perception is everything? I'm willing to bet you have associated with the wrong types. |
