I am pregnant by a soldier?

I am pregnant by a soldier, I am trying to figure out what I am entitled to. He seems to think I am in the wrong, because I am pregnant and he is married (little did i know). He and his wife are now getting a divorce and he told me that I wont get anything from him that his wife will get it all. He and his wife have no children and only been married about 2 years. With this being said, I was told my child will get all the benefits she is entitled to regardless of him being married or not. I am not to familiar with situations like this and every1 I have asked has given me a different answer. I know I will get child support and he has to carry insurance on her, but will I get any COLA or BAH? Will she get a military I.D? What all will she receive?

and no I am not just trying to get his money. I just want to know what all my daughter is entitled to.

You will not receive any COLA or BAH.

COLA does not apply to you. And unless he is stationed overseas or in Alaska. Cola doesn't amount much for him either. Cola is usually $19 to $50 depending on where he is stationed.

Since he was already married. His BAH will not increase anymore than it did when he went from single to married status. His BAH will only increase from now on if he gets stationed to a more expensive area or if he puts on rank. As his over all pay increases, your child support payments should increase also.

The baby will be covered under Tricare and is eligible to recieve medical care at any military facility or any place that accepts Tricare. So you will be able to get on base.

But you are not entitled to much more. He had an extramarital affair while he was in the military which is a UCMJ Violation and can be easily proved since you are able to produce a child. If I was him, I would be especially nice to you since his career is in your hands.

You should have thought about this before you became pregnant, but it's to late now.File for child support with him being the Father. you will need his SSN#. Trust me the military will do the rest.

The only thing she is entitled to is child support, health insurance, and an ID card. And that is it. And the child support will go through the state you live in.

Child support and medical coverage when and IF you get a court order stating he has to pay it. You will NOT get his BAH or his COLA.

There is NO reason to contact his command as this is a private/civil matter. Without a court order there is nothing they can do. He can't add her to DEERS until she is born and paternity is proven. Once you have gotten paternity proven, gotten a court order and gotten child support ordered you can forward it on to DFAS and they will start an allotment to you.

Well first you would have to prove that the child is his. He would then have to pay Child Support, and medical insurance. You should be able to get some sort of ID to allow you to use the military medical facilities, and an ID card when she is older. Military children normally don't get an ID until they are 10 years of age.

you are entitled to NOTHING.

once the child is born and you prove paternity the CHILD can get medical insurance. you will need a court order to get child support. The ID will be good for access to on base medical facilities only.

When the child is born the military may require a DNA test to prove that the child is his. Once that is done (your own cost) then the child can be entered into DEERS and is entitled to any benefits for a dependent. This means base access, use of base facilities, etc... The amount of money you receive depends on the child support the court orders.

COLA is cost of living allowance that is only for the AD member when he/she has overseas orders. The dependents only factor if he is on accompanied orders and they are with him. So that will not be a factor at all.

For BAH w/dependents it doesn't matter if there is 1 or 20 it is the same amount. If he lives in barracks and the child support ordered is more than $200 then he will get BAH-diff the difference between BAH w/o dependents and BAH w/dependents. If he is living out in town then he will get BAH w/o dependents after he is divorced as long as he has permission. If he stays married then he will continue to get BAH w/dependents and under no obligation to give you any.

The child will have Tricare for medical. IF there is Standard for the child then there is a yearly deductible and co-pay. You can use the commissary & exchange but only to purchase things for the child not yourself. You can use the Child Development Center for daycare if there is room.

All you will get child support.

Your child will be considered a dependent at birth and health insurance for two years* (I believe). This will not cover prenatal care!

+1 on contacting his command and a lawyer (lawyer as necessary).

Thats a pile of poop. How do you not know if the person your with is married? They get deployed and you dont see them for awhile and then they come home not to you. Are you sure its even his? I have watched Maury before

This is going to depend on the branch of service he is in. Your best bet is to contact a Judge Advocate General Office of his branch of service. A paternity test will be required and if the child proves to be his then this sets a whole line of action into place. If you have any problems with the JAG office then contact both the red cross and your local senator office to pursue the benefits that your child is entitled too. Best of luck to you. Also, you might want to contact an attorney on your own.

You can get child support and health insurance. Please get a lawyer and contact his commander. You will get at least 400 per month from him. Good luck.
