Yes the military member can get into trouble!
The UCMJ (Military Law) has several articles of conduct that it can throw at them (1) Adultery (Still on the Books)
(2) Conduct unbecoming (a version of catch 22 where you can be charge because the woman is still married and not divorced. (3) because the woman is still married and (the way your question is written) Married again before the first marriage was ended. they are guilty of polygamy which is also chargeable as an offense. 4) and the "civilian" woman can also be charge under Federal or Local State civil statutes for polygamy as well...

YES. And basically the military member is dealing with the potential for double jeopordy as he is governed (potetially) by both the Uniform Code of Military Justice (UCMJ) and the Civilian Criminal Codes.

The military is much less tolerant of these things than the Civilian community tends to be. Ignorance of the law is not considered an excuse. He might be (big maybe) given lenience if he didnt know.

Its hard to speak to this without knowing all the details. Get in trouble with whom? Did husband #2 know about #1? I suggest you consult a family law attorney who is familiar with the military justice system.

YES!!!!!!! Filed isn't the same as divorced!!! Major Problem, esp. considering the possible repercussions from the military.

If you're married, you've got big problems. If you're just in a relationship, its still illegal and called adultery.

I do not know if she can get in to trouble but I don't believe her second marriage is legal.

If the woman in question is legally married to more than one man, it is called polygamy. It is against the law to be married to more than one person at the same time, especially in the military. However, if a person is not in the miilitary, there are some states that do allow it. This does not include the man in the military. Bottom ine, the answer is yes, they can be in serious trouble. It might be be cause for a court marshall for the man in the military. If the woman has only filed for divorce, it still means she is currently still married to her first husband, and has not been finalized.

Only if they know you knew!!! Because then it would have premeditated and you entered into it knowing it was ilegal therefore invalid. Most likely if you are in the military you are being paid the BAH as married soldier. Everything comes down to Money and if they know of it, for them you commited Fraud!! Don't say you knew she was previously married!!!

absolutely. The ucmj forbids such acts. a dishonorable discharge can always follow breaking the law.

Ok, my fiance is a marine so I asked him. He said the man in the military could be charged or lose rank if caught.
