Just suppose that the war was based on a lie, Saddam didn't have any chemical weapons, and those Iranians and Kurds died of the flu. Bin Laden had nothing to do with 9/11, and is just a misunderstood member of the radical Islamic Peace Corps.
Murder, in any system of law requires intent. If you kill someone without the intent to commit murder, then it isn't murder. Self defense, accident, even negligence, none of these causes of death is considered murder.
Even in the Nuremberg trials ordinary soldiers were not accused of murder, only those directly involved in the mass slaughter of civilians, or those who murdered unarmed prisoners.
Unfortunately, the world does not work as simply as some people's minds. |

No, it was not murder when Clinton decided to attack Serbia (without UN approval) and bomb civilian targets based on the dubious claim of genocide and 10s of 1000's of dead Kosovars.
As for your link, were you aware that in all the reasons given in the Joint Resolution Authorizing the Use of Military Force Against Iraq, not a single one of them was about 9/11? Bush, and his entire administration made it quite clear, many times that there was no link between Iraq and the 9/11 plot. So why the obsession about a strawman? |

The leaders who issued the orders knowing that they were based on false pretenses may face sanctions, but as long as the orders were legal the soldiers are safe from criminal prosecution (as long as they don't violate the laws of land warfare.)
But remember, in the U.S. there is no legal standard for the employment of force beyond "the President issues the order, and Congress supports it." Obama could order the bombing of Canada tomorrow, and legally it would be his right to do so. |
