Is it true that once a person joins the military, he or she cannot resign untill discharged?

So if a soldier was ordered to deploy to Iraq but decided that he did not want to, refused to comply and wanted to resign, would he be prosecuted? or can he just resign and become a civilian?

When joining the military you sign a contract for a specific term. Once your term is over you may leave. Until then you are government property!

Only OFFICERS can resign their commission. And enlisted has to fulfill his obligation. By disobeying orders (eg transfer to another command ANYWHERE) you are in violation of the Uniform Code of Military Justice and you'll reap what you sow.

A military officer can resign his commission, which would make him part of the enlisted force.
If any military person does not report for duty as ordered, he is considered AWOL. If he stays gone for whatever the grace period is, he then becomes a deserter.

Certain officers can resign their commission but others can not. The regular enlisted soldier can not just quick and go home, normally that is ;-)

This solder would be court martialed. He could try the concientious objector crap - but take it from me, that NEVER works.

you hafta go once your in your in! joining the military is completely voluntary and you pretty much signed up for fighting for your country.

Don't join unless you're prepared to fight. DUH.

If you're in the military and refuse orders to go to Iraq, you'll lose rank, money, and end up in Leavenworth (military prison).

Some people are just lucky they aren't executing them anymore.

You do not get to resign the military period. You sign a contract giving a certain number of years to the military. Very very few 'honorable' ways to get out.....dishonorable will get you problems finding a decent job in the civilian world.

Resigning for an enlisted man/women is called desertion. Desertion during time of war is in theory punishable by death. But it is rarely used. Nowadays it just results in a bad conduct discharge.

That is true, once you sign your name to a
Federal(Military)Document, that is a binding contract and cannot be broken unless you commit a crime or are injured in a duty status.
Then you will be discharged. Other than that,
YOU WILL finish your enlistment committment!!
If an order for deployment is violated, the servicemember can be prosecuted under the
Uniform Code Of Military Justice!! He/she cannot resign and become a civillian!!

The last I knew, you could run off and instead of hunting you down and arresting you, they would give you a dishonorable discharge. That might not be the case anymore, idk.

There are a few ways out, but they make it really hard for you. You would not have enough time between getting your orders and the time you are ordered to deploy to properly discharge from the army. You could do all sorts of awful things and they wouldn't even want to give you a dishonorable dishcarge. You signed a contract, took an oath, that's supposed to mean something so I don't feel bad for people that want out. Think things through, people!
