My husband and the army.. help? please?

I'll start from the beginning. My husband signed up in August 2008. He is infantry and went to Ft Benning, GA. During basic training, he messed up both knees, fractures in both. After basic he was assigned Ft Lewis as his first duty station and got on profile. He can't stand for more than 10 minutes and can't carry any amount of weight. Shortly after arriving he heard the news of "we're deploying in August".. and obviously my heart stopped when I heard this. He was told he wasn't going to go to NTC due to him being on profile, but he left last week for NTC in California for a month. He's now on what they call "white cell". He sits on his butt all day, and has LAUNDRY duty for 6 hours a day. How this is suppose to prepare him for war, BEATS ME! When he returns home, they are saying he is going to go to physcial therapy.. and if this doesn't work they are going to reclass him or switch his MOS to something else. My husband thought this meant no deploying, but found out last night that the same thing happened to a friend of his and he's deploying in August but will be sitting around the whole year he's over there due to him also being on profile. Personally I think it's stupid to have guys over there that can hardly walk, etc.. who didn't even TRAIN before hand.. besides learning how to do laundry duty/gym duty/etc. My husband wants to start a family, and does not want to deploy leaving us home without him for a year. He is literally willing to give up everything to not leave for this deployment as we both do not feel like he is ready for it. He literally mentally can't do a deployment and YES I KNOW HE SIGNED THE DOTTED LINE, but he literally is willing to do ANYTHING and everything to get out. Don't say "Oh he signed up he should defend our country", because majority of the US won't sign up themselves. The army isn't for everyone and he found that out the hard way. PEOPLE MAKE MISTAKES. The world isn't perfect. I'm not trying to be rude, but I don't want people bashing my husband. We weren't married when he joined in August, and when we got married everything changed. We wanted kids, etc.. and like I said, he decided the army WASNT for him. A little too late.. we know. But I do know several guys that have gotten out of the army, we just don't want a dishonorable discharge. So PLEASE help.

So my two questions are...
1. I don't want my soldier going over there with two messed up knees.. without training since he JUST got to base not even a month ago. So how can he get out of a deployment? Is there any ways of him staying in the army (because he does enjoy his job).. and without getting discharged.
2. If this is not possible, how can he get out of the army completely without it affecting his career later down the road. My husband has always dreamed of being a doctor, and I don't want him smoking weed and getting a dishonorable discharge and it messing up his career later down the road.

Aristotle1776.. My husband has seen the PA, got on profile and he's talking about physical therapy if that doesn't help a MOS change. We are clueless, because our whole point is.. we don't want him deploying in general. I've had people tell me to say that the army has messed up his knees so he wants out in general.. but that's not what we want. We want him to stay in the army, just not deploy. If it's not possible for that to happen then we plan on going and trying to get him out in general.

During basic training, he hurt his knees and went to sick call and got his knees evaluated. They were threatening to restart him, so he pretty much kept his mouth shut and just delt with the pain in fear of a restart. He has seen the PA twice since coming to his unit. He saw the PA a week before going to NTC, and the PA advised him not to go to NTC but left it up to his commander, and of course he was sent. What do you think we should do seeing as how he's already seen the PA twice? Any advice?

Seems your husband has got himself in quite a predicament. Fortunately for him he is not alone. You said he entered basic combat training in August 2008? He injured his knees in training? Is there documentation of this?

You need to educate yourself on something called the APDES (Army Physical Disability Evaluation System). http://www.pebforum.com/forum.php is a good place to start. Sign up and post his conditions and what has unit has done thus far there.

I can tell you that if his knees are busted and he can't stand for more than ten minutes his chain of command is committing an injustice. Your husband you mentioned is infantry? This has a PULHES requirement of 111111 and he will most likely NOT meet the standard for lower extremities - this is of course, based of what you said.

He should be facing a MEB (Medical Evaluation Board) and if found unfit in accordance with AR (Army Regulation) 40-501 (look it up on google, refer to chapter 3, lower extremities, knees, and see if his conditions meet the unfitting criteria), he will be referred to a PEB (Physical Evaluation Board). At the PEB they will give him a LOD (Line of Duty) disability rating based on the DEGREE of his disability.

He will not be forced to reclass, as he does not have enough time in service. How long is his contract? If it is less than 4 years, he will be most assuredly put out of the Army with an HONORABLE discharge. Depending on the degree of his disability rating, he may be separated with severance pay (less than 30 percent) or retired with benefits (over 30%).

So to answer your questions directly:

1 - He needs to get a doctor to initiate a MEB for him immediately. He does not belong overseas as an infantryman, even though he would not be performing in that role. This can be done by bringing all relevant medical documentation and history of his condition to his unit's TMC and in particularly his battalion's PA. This individual can input a permanent profile (should be L3) which triggers a MEB. It is a long process and makes him undeployable the second he is given a permanent profile. So while he may not stay in the Army for the term of his enlistment, he will most assuredly not deploy and will not be separated in any short period of time.

2. What I mentioned prior, the MEB/PEB process, is something many soldiers go through, brand new privates to field grade officers. It will not affect his career apart from any limitations resulting from his disability. He will be discharged honorably and since his disability is service-connected his will be eligible for 100% of the benefits from the Post 9/11 Servicemembers Relief Act. This will finance four years of education at most undergraduate institutions with a monthly living stipend equivalent to E-5 w/ dependents BAH in the school's zip code.

You and your husband must be patient, the disability separation process is very long and drawn out. This is especially true for orthopedic issues. I recommend that your husband consult his chain of command immediately to get this started. He cannot fulfill the duties of his rank and position with such a condition. I wish both of you good luck.

No one wants their loved one to be deployed. It's just what happens in today's army. If he can get out of it, fine, but I wouldn't want my son to pull a double deployment because your husband has messed up knees. My son has children and a wife. Should he be denied time with his family so you can start a family? I wish you the best, but I also wish all who proudly serve and return from deployment the really best!

Not to sound mean but if he isnt fit to be deployed his DR would have put that on his perm profile. You cant really get out of it.

They can reclass him, but maybe they will give him the chance the get out. Now, what's the catch, if he choose to get out, maybe they can cut some benefits due to his lack of seniority(happened to a friend on jump school). The good part about picking another MOS is, that he's now clear about the army and how it works, so he has a lot of options to pick and get rehab. The can deploy him, he'll be doing shitty details, sad, but true. Good luck with everything...

If they change his MOS they're violating the contract he signed and he has the opportunity to seperate legally with no negative legal action. He'll get an OTH discharge which is not the same as dishonorable. Other than that, talk to the VA and see if he can get a medical waiver to avoid flight. That would also keep him out of Iraq.
