Questions about AWOL and DESERTION from Army- Have you experienced either one?? i need info, so please help!?

my boyfriend went on leave about 3.5 months ago, then he was considered AWOL, and as far as i know if you are gone for more then 30 days you will be considered a Deserter. and on friday he planned to turn himself in to tthe nearest base, but coincidentally the cops found him that day!! now he is sitting in the county jail waiting for the military to come get him, but i dont know where they will take him, will they take him to the nearest base, or back to where he was stationed? but has any of you been AWOL or a Deserter?? what was your punishment? how long does it take to find out the punishment?? can you tell me details, like step by step? please dont be rude, this is a hard time for me, since i havent gotten to talk to my bf, and i didnt see him for 3 days before he was taken to jail, i am having an extremely hard time.. well i looked on the website at the jail that he is at, and it says he is being held/felony/u.s military

so if its a felony.. does that mean he is a deserter?? im not sure if his unit deployed or not, he was station at ft. drum...

First it is not 30 days AWOL to get a desertion charge. It is just that they have to prove you had no intention to return to the military to get desertion. Before 30 days it is the prosecutions responsibility to prove it, after 30 days it is the defenses responsibility to prove he intended to turn himself in at some point. That is why they generally wait until after 30 days to charge someone with desertion.

Look up the UCMJ and you can see the potential punishments for both.

He will be taken to a military jail. They will then decide which they are going to charge him with, most likely after talking to him. They are going to yell allot and try to find out why he did it. What they do will highly depend on his prior behavior. If this was the only thing he has done wrong during his time in, they will most likely go lite on him.

Yes, if he was arrested on a military charge, it is desertion and it is a felony. He will have to say yes, I am a felon, every time he applies for a job.

Since he was apprehended by the police the military may give him a dishonorable discharge and some federal jail time. It depends on the branch of service etc.
If on the other hand he had of been smart and turned his self in then he would probably have gotten a general discharge and had to do his "time" on base doing menial labor etc. but again it would depend on the branch of service and the reason he went AWOL in the first place.

My nephew was AWOL for 6 mths and the Marines gave him a general discharge and he had to do his time on a base closely supervised for 6 mnths. His sentence was a lenient one because he served a double amnt of deployment during Desert Storm and his reason for being AWOL had to do with post traumatic stress and an ill mother.

I went AWOL in 2001, two months before 9/11. The jail can hold him for 10 days. Many times the army will not show up and they have to let him go. They sent a fax to let me go and for me to drive to my old base and turn myself in. As long as he did not dodge deployment orders they will just yell at him and discharge him in about 60 days. By the way, the discharge probably want hurt him getting a job. I am a teacher and it has never come up.

lastly, it is not a felony. Just a federal warrant. Soon as they pick him up it will be out of the system.

i went awol after the war broke out if you went awol after the war broke out you would have a RE4 other than dishonorable discharge

My son went to the Army in Oct.2008. He was deployed to Aghan. in August 2009. He came back on a 2 week R&R. On the day he was suppose to go back he called me and told me he was experiencing PTSD from seeing some buddies in his combat getting killed and he having to kill some kids. I called to the base to see what can I do to get him some help. I took him to the base to turn himself in and he was considered AWOL. He went through counseling for about 2 weeks and they were ready to send him back to Afghan. He refused to go and later AWOL again. He was gone for 10 months which I assume is consider a deserter now. He haven't got into any trouble since he has been gone but has a son and another one on the way. He turned himself in and plan on asking for counseling for his PTSD. I would like to know what can be the punishment he can receive for his actions?
