An American soldier accused of rape and murder of an Iraqi girl must be tried in the court that has jurisdiction of the area where the crime was allegedly committed. Custody of the soldier must still be with his unit unless the Iraqi law do not provide bail for a temporary liberty from imprisonment. When the soldier is found guilty by the court, then he must be turned over to the Iraqis for imprisonment or execution under the Iraqi law. |

No; they will give the guys far worse punishment than is needed. Although we have had/will have people in our court from different countries, we gave them a truthful and right trial. I don't think the Iraquis will do the right thing. |

I believe the Geneva convention would prohibit this I am not sure though. I believe they have to be tried by US authorities. |

Last time I heard, there was no DNA evidence to back up the accusation. I agree with whoever said let the US try them, and only if they're found guilty do we turn them over to the Iraqi government. But if they're found not-guilty, then it could just be a smear campaign.
BTW, when my dad was in the Navy, that was the general rule. If a sailor messed with an Islamic woman in an Islamic country, the Navy washed their hands of him. Dad remembered getting the warnings whenever they made port. |

Ok of those two choices, I would go with the ICC for prosecution of war crimes.
What I don't agree with is the USA prosecuting them. If not the ICC then they should be given to the Iraqi government. I mean that is what Bush is telling us right... that the Iraqis have an independent government with their own courts and constitution.
If an Iraqi did the same here, we would put him on trial here. |

Fraginal is correct; the UCMJ provides for service members who have committed a non-combat related crime to be turned over to the appropriate jurisdiction authority if the military finds the charges are reasonable and justified. |

Yes let the Iraqis take care of them.
Even if they don't get to, those soldiers are going to have nightmares for the rest of their lives and will never be able to reclaim their lives as they once were. Guilt has a way of doing that. Karma will prevail just as it always does.
It would benefit some of you to go to youtube.com to see what some of our soldiers are "really" doing over there in Iraq. Some of them are shown taunting Iraqi children with water! These are all the worst crimes against humanity ever. Look what our government has them doing in the name of oil and greed. |

There is no Iraqi government. they are America, we enforce their laws, rules and everything else. Besides, Iraqi's laws are much different than ours, I wouldn't want my enemy being tried there, let alone our troops. |

Why should we turn our people over to foreign courts for cases which we retain jurisdiction and we have a demonstrated track record of fair and effective justice?

I don't know you know the troops have been there so long that their mind is completely gone. They see nothing but death, blood , bombs, buddies being slaughtered. If a person's mind has completely been stressed to the limits they may not be capable of really knowing what their doing. Don't get me wrong they need to be given the worst punishment, but I think lock them up in a Insane Asylum for the rest of their lives, that would be the worst punishment they could receive |

Its a grave matter of concern to the humanity...But if they're turned over to Iraqis, they're probably gonna torture them to death...So the proper thing to do is to turn them over to an international tribunal which has got nil American influence to try their cases and reward them the most punitive sentence... |
