Soldier about to deploy, need to get out of lease..?

Dear (property manager),

I am writing to inform you that we wish to terminate our lease early due to (soldier's name)'s enlistment and subsequent deployment into active service in the (branch of service).

While we have always been pleased by the service and understanding that you have provided to us, we wish to released from our lease without fault as provided for under SCRA Lease Termination Provisions.

Enclosed are a copy of my orders for verification purposes. Again, we are grateful for everything you have done in order to satisfy us over the duration of our stay but must vacate in order to follow these government-issued orders.

He needs to show a copy of the orders stating that he is deploying. Now if your name is on the lease as well as his they can still hold you to it, in which you will have to pay the penalty.

Just type up a basic letter like:

To Whom it may concern:

I have attached a copy of my orders that show that I will be deploying overseas with my military unit. Because of this I will be needing a release from my lease.

Second, the terms of the lease agreement should be listed on the agreement itself. That should spell out exactly what will happen if the lease is to be broken.

I would first just go in person and give a verbal notice and take along proper document showing his state of deployment. The landlord is likely to make copies and type up something for him to sign.

He doesn't need a template; he just needs to hand them a copy of his deployment orders. That is usually sufficient to break the lease. This will only work if the lease is in his name. If it is in your name and not his then the landlord doesn't have to do anything and can still charge you for breaking the lease. According to the military, boy/girlfriends and fiances don't exist; either you are single or you are married.

Don't over think it.

Just type up a few lines that say when you intend to vacate the premises due to the deployment and include a copy of his orders.

Sign it on the bottom.

Does not need to be fancy. Just state that he is being deployed and will need to terminate the lease. You may need to show copies of his deployment papers.

Its called a military clause. Always get one. I would just take a copy of the orders. Thats usually all they need.

He needs to take the land lord a copy of his deployment orders. If he insist on doing something prior just do a letter stating that he is breaking the lease because of deployment. What the last day will be and have him sign it.

Are you on this lease to or is it just him? If he's still there then you can't break the lease for him he will have to do it unless you have a POA and even then they will more than likely want to talk with him about it before they do anything final. More than likely if you're on it they will make him transfer it to you especially since you're not married and you aren't protected under the Soldiers and Sailors Act like he is. They will do this to protect themselves and to keep from losing rent and having to find another tenant.

ETA: Good then it should be as simple as just giving them a copy of the deployment orders. :-)

Was there a military clause in his rental agreement? If not, they do not have to terminate his lease early and may charge you. If there was then all you need to do is call them let me know that he is deploying, ask when they'd like you to bring a copy of his deployment orders by and what the last month you'll be living there is.
