Nope, because we are not now, nor ever have been at War with Afghanistan.
But Congress did pass a Resolution on September 14, 2001
To authorize the use of United States Armed Forces against those responsible for the recent attacks launched against the United States.
Whereas, on September 11, 2001, acts of treacherous violence were committed against the United States and its citizens; and
Whereas, such acts render it both necessary and appropriate that the United States exercise its rights to self-defense and to protect United States citizens both at home and abroad; and .....
2. people have the mistaken belief, that for the US to use military force, Congress must declare war.
Or even how Congress must declare war.
IE: some people seem to think that Congress must pass a bill that says " the US declares war on XXX "
But thats not what the Constitution says.
The Constitution says, "the power to declare war, rest with Congress."
It doesn't say war must be declared or how congress must declare a war. |

The US has not officially declared war on any country since WWII. We didn't do it for the Korean War, Vietnam War, Gulf War, War in Iraq, or War in Afghanistan.
I bet you are going to try to say that because we never officially declared war, that our invasion was unjustified and it is an illegal war. That would be wrong. One does not always need to declare war to mount an offensive operation. |

It was never officially declared a war... we are at war with the taliban & radical extremists...but if you ask me... as long as our men are putting their lives on the line and dying in the line of duty... its a war. |

Bush was authorized to go after OBL and alqueda. the govt of afghanistan- the taliban, asked for proof of OBL involvement- since he had gone on tv and said He didnt do it...so Bush rather than show the proof and get OBL, opted to attack the taliban |
