What do I do to turn my ex husband in for frauding the military?

My husband has left our children with me since december. He has not gave one cent to help with them and has seen them few times. He is in the military and hasn't let anyone know that they are with me and therefore is still drawing extra money for them. I know where his unit is but not sure where to start or what to say when i call to inform these ppl and have him turned in.

Yes i know but here is the thing. We have joint custody. He just chose to give them to me so he wouldn't have to deal with them i guess. But he wouldn't agree to change the papers more than likely for the money part. That still shouldn't change the fact of what he is doing right?

Just let his CO know what is going on.. you shpould be recieving money for his children along with the privalges like the px and hospital visits

hmmm...well one of two things. If you want child support, you can go about this differently. He is required to pay a percentage per child and you can get them to make him pay this. If you go the "fraud the gov route" he will be busted and that percentage will be considerably lower.
Depending on what branch you can go on the internet and get his unit/base's info and call his commander.

How do you know that he is still getting extra money?

By opening his mail? (federal crime)
By accessing his MyPay account? (also federal crime)


You might want to be careful here. If it is a bad divorce, accusing him using information that you shouldn't have access to might bite you in the behind.

Technically if you are still married then he can receive the BAH. He is suppose to provide for you. However they could have already moved him in the barracks and taken his BAH.

To get child support you have to go through regular family court the military has no say in this.

Your children are still HIS dependents entitled to medical, and dental, and yes he gets extra money for them. What he gets is not illegal.

You need to go to court to get the custody changed. From joint to sole, or he never has to give you a cent.

if the paperwork says he has custody he is entitled to the BAH with dependent rate/. period.

technically he is NOT defrauding the government.

take him back to court and remove him from custody,and you have a case. .

First, or you divorced? or seperated? both have joint custody issues.

Did the courts award you child support? joint custody or not, there has to be a provision somewhere about who supports what when and how. If you have the children, then you are entitled to something to support them if he isnt.

were you married more than 10 years while he served in the military? it matters for issues after his retirement. you may be entitled to half his retired pay. I know, cause thats what my wife got as part of the property settlement...and we are just seperated.


If you know where the unit is, start with the unit first Sergeant. Unless there's something you haven't told us, and this is truly a case of desertion of his family, that's the first place to start. have your facts in order. If you cannot get justice from this person, go up in his chain of command to his commanding officer. what do you tell that person? you tell them the facts. no emotion, just tell them the facts.

Non support of your dependents is a serious military crime. he is supposed to once a year certify that he is taking care of his dependents. If he is not...

I can only answer this if your husband is serving in the US Armed Forces. First of all, are you divorced or legally separated? If you are, then you need to take your court papers to the local JAG (Judge Advocate General) office. They will be able to assist you further.

If you are not divorced or legally separated, then you need to file a separation complaint with the JAG office. They will ask you for information on where you currently live, how long it has been since you received any financial support, when the last time you or your kids saw your husband, how often he visits, etc.

If your husband is serving in a classified position (which is possible, but not likely), then you can ask to have his pay diverted to a band account that you have access to. This is necessary since, if he is working intelligence or other special forces-type assignment, he might not be able to tell you where he is, etc.

If it is just a case of family abandonment, he is subject to the penalties of the law where you reside as well as to the UCMJ (Uniform Code of Military Justice), which governs the affairs of the military. Think of it as the law for soldiers.

Regardless of the issue, your first step is to contact the local JAG office on base. The next step is to meet with his commanding officer. Trust me, if they knew that this was going on, they would not tolerate it. Let them know where you are and they can then take care of you.

The only "extra" pay he would be getting for having children reside with him is BAH w/dependents. If he has remarried then he is legally allowed to get BAH w/dependents because his new wife is a dependent. It doesn't matter if he has 1 dependent or 20 he will only get BAH w/dependents. The difference between that and BAH w/o dependents is around $200, maybe a little more.

If he isn't paying child support then you need to take him to court to have custody turned over to you for more than 50% of the time and child support ordered. It doesnt mean though that you will get it. If you are earning enough money and you do have 50% custody then the court can order no child support as you are both doing it. He would also still retain BAH w/dependents if he hasn't remarried yet.

You really need to consult an attorney about filing to get child support. Then call the Judge Advocate at his duty station and inform them of what is going on they will be able to direct you. You can also call his commanding officer if you know the exact unit he is in.

call the unit, and say you want to talk to the Company camander of this soldier ( your husband) they will transfer you to the Co.. explain the whole explanation and you will get taken care of...

Simple.

Call his unit, ask for his immediate superior officer (not his superior Non-Commissioned Officer). The Base Operator will be able to give the phone number of his unit. Tell him what is going on. Give whoever you talk to (whether he be a Lieutenant, Capt, Major, whatever) you contact information and tell them you wish to hear back in 24 hours.

In 24 hours, if you have not heard back, call them back. Ask for the Unit Commander. If they don't have something rolling or blow you off, tell them you are calling your Senator and your Congressman and will request a "Congressional Inquiry". Write down who you talk to, when you talked to them.

Then call your Senator and your Congressman.

Nothing gets a C.O. moving like a "Congrint".

If drawing extra money doesn't benefit you (or the kids) it could appear as fraudulent behavior. Might be a case for the police.

We don't have the same system here in Denmark, so difficult to say specifically....
