Why can't the U.S. navy send in the Navy SEALs and free that American Skipper?

so if the U.S. has ships like 200 yards away from the Sammie Pirates who are holding the American Skipper captive, why cant they ( under cover of darkness) send in some Navy SEALs ( by scuba diving) and like throw some Flash bangs and take out the Pirates then free the Skipper?
this is really the obvious answer to this whole problem, but I just have a feeling that the U.S. has some stupid lawmaker saying that we cant do that because it might hurt some Pirates or something retarded like that. but this guys life is in danger!
