Why is this captured Somali Pirate still alive? Shouldn't he have been executed already?

A Somali pirate's warning:

"The killing of our boys was aggression, and the U.S. will see what they get from their operation."

These people, aside from being stupid, are not to be treated equally under the law. They should be shot on sight at sea, no negotiations, no "fishing vessel" status. If they are detected on radar, the U.S. and French Merchant Marine and Navy should sink their vessels and leave them at the mercy of the sharks or the sea.

Anyone who feels otherwise is just inviting further attacks and cares not of the fates of the crews, since it's not their butts on the line out there.

When they shot the first three - that was justifed - they were holding a gun on the Captain. The fourth one wasn't holding a gun and surrendered. We don't murder people once they surrender.

he gave himself up, we kill when needed. Besides let the general prison population take care of him, I heard they don't like terrorists to much.

EDIT-Just because he isn't entitled doesn't mean we won't give him one, what about illegal immigrants, they still get trials and prison time and after that they get deported. With a life sentence in jail, that is pretty much giving him a death sentence.

Because piracy is not a death penalty crime, and hasn't been since the 1800s.

I do realize that is unpopular with some, but it is what separates our actions from those of the bad guys.

EDIT FOR OP: Yeah, I hear you. Why bother with something as troublesome as a trial? Why not just disgrace ourselves by executing a 16 year old without representation and trial. I won't even bother to correct your ignorance of law and the Constitution.

Your a little out of step with the times.

The Geneva Convention on the High Seas of April 29, 1958 and the 1982 United Nations Convention on the Law of the Sea allow pirates to be apprehended on the high seas by the authorities of any nation and punished under its own law. This means the suspect is subject to and punishable under U.S. law. So yeah, he is absolutely entitled to a trial in the United States.

Executing pirates is a 17th century holdover. No modern 1st world nation executes pirates anymore.

While there may be no question of his guilt, it will be certified in a court of law. He will be lawfully tried and then lawfully punished and no one will have any legitimate complaint about our actions. We won't get the same from other countries but we are only responsible for our own. Over the last 8 years we haven't been able to hold our head proud and high over our commitment to law and justice but there's a new man in the whitehouse now that seems to hold "honor" in high regard.
