It should never be allowed while driving.Total focus on the road,other vehicles,pedestrians etc..If a person needs to use the phone they should pull off the road and park the vehicle then and only then is it safe to do so.

I don't think we need a separate law for driving while using mobile phones. If you are not in full control of the vehicle you are already braking the law. Due care or reckless.This includes hands free since you may still be more engrossed in conversation than your driving.
Or we need separate laws for the following:
Eating sandwich's, drinking from bottles, rolling cigarettes, reading news papers, books magazines, playing bagpipes etc etc etc.

You MUST NOT use a hand-held mobile phone, or similar device, when driving or when supervising a learner driver, except to call 999 or 112 in a genuine emergency when it is unsafe or impractical to stop.

Using hands free equipment is also likely to distract your attention from the road.

It is far safer not to use any telephone while you are driving - find a safe place to stop first.

You can use it any time as long as you are not holding the phone.

You're even allowed to use your fingers to press the buttons on the phone whilst driving, (as you do with the radio), as long as you're not holding it. (of course if pressing buttons is distracting your attention from driving you could be guilty of driving without due care and attention...just as you could be whilst tuning the radio).

So if your mobile is fastened to the dashboard and you have a loudspeaker or handsfree kit then you can use it all the time.

Seems stupid really, because someone who is on the phone is not giving their full attention to driving. Using the phone whilst driving should be banned completely.

He is not allowed to handle the implement at all. If he needs to take or make a call, he should legally park the car first. Stopping in what appears to be a safe place on a clearway does not make it a good decision.

Only when using a handfree kit.

However it is safer to pull over to an appropriate place at the side of the road (not the hard shoulder/near a bus stop/junction etc.) as this will prevent the driver being distracted from driving.

Judging by the everyday cases on the road however, BMW X5 drivers may be exempt from this law.

You are allowed to use a hand held phone whilst driving to make an emergency 999 call, if it is a perceived life threatening emergency and there is absolutely no safe place to pull over.
