This may settle the argument from the highway code:
http://www.highwaycode.gov.uk/05.htm#75
It's basically saying that anyone under 14 - the driver is responsible
Anyone over 14 - the passenger is responsible |

the driver is responsible, but if the passenger has a drivers license then they are also responsible (this is in california, it may vary in other states) |

in ireland anyway, the driver is responsible for seeing that passengers under seventeen are seatbelted if under seventeens are not wearing seatbelt, the driver is fined/gets penalty points. passengers over seventeen are their own responsibility and they will be fined if not wearing a seatbelt. |

Yep, the break-point is 14 years in the UK as already said. Having said, that, I have been known to refuse to move the car unless everyone belts up - not a legal requirement but better for my peace of mind! |
|

kenjinuk
 |
it is the drivers responsibility for all the passengers. |
|

glen

The driver is responsible for using the seat belt before moving (driving) the car. The driver ensures that all passengers are wearing seat belt before driving the vehicle. All passengers should wear seat belt before driving the vehicle. |

Would you drive a car with passengers who wouldn't belt up? Particularly someone in the back without a belt on - in a serious head on crash would be catapulted into the seats in front - injuring or killing the occupants. Anyone who wont belt up, walks! |

The Driver is responsible for his car. It is the drivers responsibility to ensure the safety of the vehicle and the occupants. |

It used to be the driver, but I think that it is now the passenger unless a minor... |

the driver if the person is under 14 years old, the individual over 14 years, however the driver should tell them for safety as the police if you are stopped will then proceed to check everything around the vehicle further delaying your journey. so BELT UP. |

if you are an adult that person is responsible, but for children the Adult is responsible. |
|

trixa

the driver is responsible for children and any adult passengers are responsible for them-selves. in the UK |

The driver is responsible. Even if he is seatbelted and your not...he will get the ticket. |

Well I dont know if this is federal law or if its just in the state of California but the way I know it to be is the driver is responsible for anyone not wearing a seatbelt UNDER the age of 14 if someone in the car over the age of 14 is not wearing one then they are responsible and NOT the driver.
Hope this helps. |

Steve F, Cloth, Lady J. and Mr. Sceptic have it right (for UK). The rest are either guessing, or americans. |

The driver is responsible but if the passenger is over 18 they too can get a ticket.
Talking about a double ticket.
Your husband could sue the passenger! Get your money, and lose a friend.
I just don't drive until everyone seat belt is on, or they can walk. |

I think the driver is responsible for anyone under the age of 14. |

The driver is responsible, unless the passenger is an adult.
In that case the driver must have told the passenger to put on the seat belt, and the passenger must have refused to do so |

In Kansas every legal adult (above 18yo) is responsible for fastening their own seat belt. The driver is responsible for all minors in their vehicle. |
|

Under 16 then the driver is, over this age then it's the passenger. |
|

jbearbooboo
 |
the passenger is responsible for his/her seat belt. |

Lady_J

It depends on age, those above 14yrs are responsible for themselves (i.e the passenger) but under 14 it's the driver who's responsible. |
|

Polo

I think it's the passenger that will be fined for not doing so. |

The ( individual) passenger is responsible to follow the law and buckle -up! |

It used to be the driver, but the furkwits in government realised that was bloody stupid. So now it's the passenger.
How many prosecutions do you know of? |

Under UK law the driver is responsible to ensure all passengers under 14 years of age are belted in.
Passengers over 14 years of age are responsible for themselves, and can be fined. |
|

cloth
 |
In the UK the driver is responsible for every passenger in the car under 14 ,over 14 its the responsibility of the passenger.
This is Law from 18th september 2006 |

Mr Sceptic

In England, the individual passenger is responsible for their own seat belt. The driver is responsible for ensuring that children under 14 have their seat belt on. |

The passenger gets the £30.00 fine - the driver gets a producer and a grilling from the police xxxxxx |
