This may settle the argument from the highway code:

It's basically saying that anyone under 14 - the driver is responsible
Anyone over 14 - the passenger is responsible

the driver is responsible, but if the passenger has a drivers license then they are also responsible (this is in california, it may vary in other states)

in ireland anyway, the driver is responsible for seeing that passengers under seventeen are seatbelted if under seventeens are not wearing seatbelt, the driver is fined/gets penalty points. passengers over seventeen are their own responsibility and they will be fined if not wearing a seatbelt.

Yep, the break-point is 14 years in the UK as already said. Having said, that, I have been known to refuse to move the car unless everyone belts up - not a legal requirement but better for my peace of mind!

Would you drive a car with passengers who wouldn't belt up? Particularly someone in the back without a belt on - in a serious head on crash would be catapulted into the seats in front - injuring or killing the occupants. Anyone who wont belt up, walks!

The Driver is responsible for his car. It is the drivers responsibility to ensure the safety of the vehicle and the occupants.

the driver if the person is under 14 years old, the individual over 14 years, however the driver should tell them for safety as the police if you are stopped will then proceed to check everything around the vehicle further delaying your journey. so BELT UP.

Well I dont know if this is federal law or if its just in the state of California but the way I know it to be is the driver is responsible for anyone not wearing a seatbelt UNDER the age of 14 if someone in the car over the age of 14 is not wearing one then they are responsible and NOT the driver.

The driver is responsible but if the passenger is over 18 they too can get a ticket.

Talking about a double ticket.

Your husband could sue the passenger! Get your money, and lose a friend.

I just don't drive until everyone seat belt is on, or they can walk.

I think the driver is responsible for anyone under the age of 14.

The driver is responsible, unless the passenger is an adult.

In that case the driver must have told the passenger to put on the seat belt, and the passenger must have refused to do so

In Kansas every legal adult (above 18yo) is responsible for fastening their own seat belt. The driver is responsible for all minors in their vehicle.
