As far as I know u DO have dual citizenship. Ur mom is a native German N since u were born in the USA u hold citizenship for Germany and USA.

By the way it is their job to be helpful, so if you phone again, get the name of the officer you are talking to and file a complaint if they do not help.

To have German citizenship, one or both of your parents must have had German citizenship AT YOUR TIME OF BIRTH. They don't have that by being born there, though. One of their parents (or, back then, basically your Moms Dad) must have had German citizenship at her time of birth.

If that is the case, DUAL citizenship is recognized by Germany ONLY UNTIL THE AGE OF 18 or 21 respectively, since the German state does not accept/recognize dual citizenship in adults, per se. There are exceptions, for instance if you have extensive property in Germany or the US.

If you are still underage, you should have dual citizenship automatically if one of your parents was a citizen of Germany/ had German nationality, and you can apply for a German passport. Note, though, that you will have to decide which nationality you want to have for the rest of your life by the time you turn 21.

When you say through birth, do you mean she was born in Germany to German parents?

Or is she a citizen by descent, her parents are German citizens but she was born in the US?

Or was she just born in Germany & you're assuming she has German citizen?

You cannot apply for dual citizenship, there is no formal application you can make - all that's required is the laws of both countries allow you citizenship & there is obstacle posed to you holding citizenship of another country. In this case if you are entitled to American & German citizenship then you simply apply for American and German passports to prove it
