Would an American citizen get away with this?

A Dallas police officer ticketed a woman for making an illegal u turn and not having her license on her. She spoke no English so he put "not able to speak English" on the ticket not realizing that law only applies to truck drivers so he wasn't being discriminatory. The Hispanic community got up in arms and not only was the ticket dismissed but the Dallas Police Dept apologized to this woman. My question is why was the ticket dismissed when the woman did make an illegal u turn and was driving without her license (she left it at home). Making an illegal u turn could have cause an accident. She's been in this country since 1980 and hasn't picked up one word of English and is going to sue the Dallas Police Dept. because she had to spend the weekend in the hospital for anxiety and stress. Would someone born in America get away with this and does this mean there's going to be new laws for Hispanics and laws for the rest of us?

Thunder - I did post in my question the fact that the law only applies to truck drivers and not regular vehicles. If you do research online you will find out that the whole ticket was dismissed. The question is far from ridiculous. If you lived in Dallas would you be prepared to use your tax dollars to give to this woman who clearly broke the law when she sues?

Ridiculous question and you are completely uninformed about the incident. The charge for the illegal U-turn was not dropped. The charge for not speaking English was dropped - because it was not an actual charge. The officer was a trainee and charged her with violation that doesn't exist for normal drivers (you are only required to speak English if you are a commercial driver.)

This what happens when your country is infected with Political Correctness, and allows Advocates and communist organizations like ACLU start influencing the government, and stripping away constitutional rights in favor of their made up rights. It would make no difference if this person, although hispanic, was born here or not. Just the fact they she was hispanic meant that she was afforded special protections not afforded to caucasians. This is how twisted the system has become because of Advocates, Special Interests, and the likes of outfits like the ACLU. Get rid of them, you solve the problem.

This is a rediculous case. The woman should be charged with the U-turn regardless. By far the lawsuit against the police dept. should be thrown out. The anxiety and stress was caused by her own irresponsibility and actions. Anyone with any sort of common sense should know that if you are going to do something illegal, especially when it can put lives in danger you must be willing to take responsibility of your actions.

Your question is why the whole ticket was dismissed when 2 of the 3 charges could have been held again her? Because the policeman ticketing her for not speaking English was seen as racial profiling, especially when this was the 39th time, such mention was written on traffic tickets in Dallas. No federal or Texas law mentions sanctions for not speaking English for passenger car drivers, which is logic because I can't imagine the number of American tourists abroad who would be ticketed for only speaking English and expecting the policeman whois pulling them over to speak and understand English.

If the policemen don't want to see their work bashed, they shouldn't be negligent when doing their job. The law says that passenger car drivers should not be ticketed for not speaking English, well just apply the law. Indeed, one tiny procedural error is an argument for the accused. So just ease the work of the prosecution or the judge by doing things properly, if you don't charges overthrown for procedural reasons.

So, to answer your question: if Rookie just indicated the only 2 charges related to car passengers traffic regulation, your tax dollars (and also the tax dollars of the hispanic community) wouldn't probably go to that woman.

Citizens aren't the only ones who can file frivolous lawsuits. But the woman should be punished to the full extent of the law for making that illegal U-turn. Oh, where is the justice?

No, a US citizen would not have gotten away with that. I also seriously doubt that most other immigrants would have either. The squeaky wheel theory holds here. In any case, she was driving illegally. The Mexican community claims they want to be treated the same as everybody else, or so the claim, then they should be taking responsibility the same. She broke the law and needs to suffer the consequences of her actions.
