i wanted to ask, that my ex wife came to the uk from pakistan on a spouse visa and we divorced after a few months and had a child, on june 2009. i have had no contact with my wife since august 2008. she has managed to make a british passport for my child and take him to pakistan without my consent. my question is that how was it possible for her to make a british passport without me giving my details, i suspect my signature was forged and my details used without my consent. can some one please clarify? she has no british status, i am the only british parent. Additional Details sorry let me make this more clear, my name is on the birth certificate, i divorced her because of her demands to call her family over and that was her condition if i wanted to stay with her. getting back to the point i applied to get contact with child once she recieved summons she done a runner to pakistan, which was unexpected i have nothing against my ex wife just want to see my child and was wondering how she managed to make passport. sorry if i sound like im after revenge but im not just want my child to be safe and sound.

Your child was born in the United Kingdom. Hence, he is a citizen of Britain. No law can deny a passport to a Britain born infant. Your wife now can also become a citizen since she is a mother of a citizen. By the way, they don't need your signature or your contact information or your consent because your wife now has the birth certificate of your child proving that the child was born in a hospital in Britain to her.
Your question has the dates messed up. You have no contact with your wife since August 2008 but she had a child in June 2009? Mate... this gives it a totally different meaning but hey who cares as long as your question is answered. The child is a British citizen hence he/she gets a British passport.

You were married to her for most of the pregnancy. If you jointly signed the baby's birth certificate that would have been enough to prove that you're the baby's father. Your British birth certificate or passport would have been enough to provide evidence of your citizenship. You divorced her. She probably wouldn't need you to sign - unless you have a parental responsibility order or agreement. |

Are you sure she made a UK passport for the child it seems unlikely since she is a foreigner in the UK ? But obviously she has kidnapped the child..But more than likely she had a pakistani passport made..She did not need your permission to do so,but on the UK one someone made a big error.
.If it is the case you are going to have a hard time recovering the child.

Very odd, are you sure the passport was British?
On a separate subject, as she had no right to stay in the UK once you were divorced, what did the settlement say about who would take care of the child? I presume it was expected that she take the baby home with her when she was forced to leave the country once her visa ran out?
If the intention was for her to take care of the child, why are you worrying about the ins and outs of the passport? The baby obviously needed one and it would have been unreasonable of you to refuse him a British passport if he was entitled to it.
Edit: to the flat earthers from the USandA, being born in the UK does not automatically make you British, we have no forced citizenship here. As the child's mother only had a spousal visa, his father would have been the only one able to confer citizenship as he states correctly in his posting.
Second Edit: I agree with Maggie, you sound like a real low life. What did you think should have happened to this child after you divorced her mother? She lost the right to live in the UK thanks to your action!
You are angry that you were conned into marriage and now are hell bent on revenge with your child as the weapon of choice. Nice.

The child is entitled to a British passport as its father is a British citizen, not because it was born in the UK. The mother has no rights as she would have to stay married and living to the UK citizen until she applied and received Indefinite Leave to Remain if she was to be able to stay in the UK. Since the marriage broke up before then, she has no rights to stay in the UK.
Where a father is named on the birth certificate and unless the mother has a court order granting her sole responsibility, she must have the father's permission to apply for a passport for the child and to take the child out of the UK. This is because Britain is signed up to the Hague Convention treaty on International Child Abduction. Pakistan is not signed up to it.
Unless your wife is an elephant, either you have the dates wrong or this is not your child. The child was born in June 2009, but you have had no contact since August 2008? Insemination by proxy?
Are you named as the father on the child's birth certificate? If not, there is nothing you can do.
Also what is your intention here? You have not seen your wife since August, so presumably you have not seen the child either. Do you want the child brought back to the UK or merely to get at your wife for forging your signature. If so let it go.

Unfortunately this is another example of one rule for men, and another for women. If YOU had got the child a passport and taken him abroad, you would be national headine news, and would be hunted for abduction. Yes, a man can "abduct" his own child! But if a woman does it, that's okay.
EDIT - still need some more info on the birth certificate and divorce. I see your name is on the certificate. Clear a few things up:
- was your divorce before or after the child was born? If it was after, UK law always presumes the husband of the mother to be the father. This presumption is rebuttable though it must be proven otherwise. A married father must be entered on the certificate, whether he attends registration or not.
- was the birth after you divorce? In this case, you had to go and sign the register yourself in person. This gives you "parental responsibility" but not the same rights as a married father (a married father cannot "abduct" his own child, and is equally entitled to custody of the child as the mother is, unless a court decides otherwise. But an unmarried father is not as well protected in law as a married one, basically the power lies overwhelmingly with the mother.) |
