I am 22 weeks pregnant and I am a us citizen and my baby's father is a british citizen the baby will be born in the us where we both live but I was wondering if the baby will have dual citizenship and if so how do we apply for it?

Your baby will definitely be able to apply for it, my grandpa was born in Ireland and I can apply if I want to. You may not even have to apply, it's dependent on the laws in the UK. I know that a foreign born child of a US citizen is automatically a citizen without having to apply. |

If the father is a British citizen, born in the UK then the child should automatically be a citizen. All you need do is apply for a passport if you want, you could also register the birth with the British Embassy.
If the father is a citizen by descent, not by birth, then you must register the child's birth the British Embassy before the child turns 18 so the child can claim British citzienship otherwise the child will lose the right to claim British citizenship.
I will say if ANH wants Irish citzienship & wants it to be passed down to her kids, she needs to get on the Foreign Births Register now. Grandchildren of citizens born in Ireland must prove they have the right to Irish citizenship & their citizenship doesn't start until the day they go on the Foreign Births Register. Irish citizenship can in theory be passed down indefinitely but only if each subsequent generation follows the correct legal procedure & goes on the Register. |

It depends. How is the father a British citizen? If he is British not by decent..then he can pass on his citizenship to his child. If he is British by decent, he can not pass on citizenship. So ask him, he should know.
When the baby is born, all you need to do is apply for a British passport. You do NOT need to register the baby first. All that gets you is a certificate of citizenship (which the passport stands for as well) and you have to pay a large fee. Go straight for the passport.
Now, this is important. We were told by the British consulate to apply for the British passport first. Then when we had that in hand we could apply for the American passport.
Yes the baby will have dual citizenship as soon as you get the passport. However the baby will be British by decent (assuming dad is British not by decent) and therefore any children that baby has will not be British unless they are born in the UK (hope you understood that lol)

There are some instances where UK citizenship cannot be passed down it all depends how the father received his citizenship ? Ask the father about it or check the UK Embassy in the US but until you know how about the father's citizenship do not apply. The child may have to be registered first depending.

It all depends on how the father is a British citizen. If he was born in the UK, or naturalised as a British citizen, then he is a "British citizen not by descent", any child of his is automatically a British citizen, and therefore your baby will be born with dual citizenship. You don't have to apply for it.
As it will not be born in the UK, then if it is a British citizen, it will be a "British citizen by descent" and any children they have will not be British citizens unless they are born in the UK.
Assuming your baby is a British citizen, you might like to register it at the British Embassy so that it has a British birth certificate as well as an American one. How to do it is here http://ukinusa.fco.gov.uk/en/help-for-british-nationals/living-in-usa/birth-registration/ It's not necessary as your baby (or you on their behalf) will always be able to apply for a British passport by submitting all the same documents with the passport application. The required documents are the baby's birth certificate showing names of both parents, yours and the father's birth certificates, your marriage certificate, and possibly a marriage declaration form completed by both of you which you can download from the British Embassy web site. Bear in mind that it is more difficult if you and your baby's father are not married - in that case it will save a lot of trouble for your child later on if you DO register the birth at the British Embassy, and you need to call the Embassy on (202) 588 7800 to find out how to do it. |

Your baby will be automatically a US citizen because he will be born in the US. Your child will not become automatically a British citizen at birth in the US.
Your child will become British citizen by descent (Only if his/her father was born in the UK or he became a naturalised British citizen in the UK). You need to apply to the nearest British Consulate in the place of your residence or contact the British Embassy if you live in Washington DC.
If the father is a British citizen by descent (because one or both parents were British) your child cannot become a British citizen, If so, the only way that your child will become a British citizen is by birth in the United Kingdom |
