sounds to me like you got screwed, there is no one to sue, stop being such an American, pshhh thats all were good for anyways

you file a report now. then you sue the guy for not having insurance on his car and in my state, that is illegal. i would add your driving friend also. get going asap

Talk to a compensation company, the ones from the adverts that say 'Had an accident that wasn't your fault? Call now!' They'll usually sort it out with good results. I got £500 when I wasn't injured at all and had no medical bills to pay.

call the police station, and they could help you find out! then you have to pay tons of money to a lawyer! i don't know why you people don't make phone calls first, before posting questions?

Get a lawyer and start with what you know. First know that your friend is being advised by her parents as you should be by yours. What you believe to be true is not necessarily the truth. The injuries indicate that you really don't have much choice but to sue regardless of the ability of anyone to pay. You are learning how loosely you may have been using the word friend. Let your attorney handle it.

it doesn't matter that it isn't your fault, if the car was uninsured the driver is automatically at fault.
contact the police, if two other cars were involved it is more likely that you didn't know about the police report, unless you hit some pretty shady people who didn't want to stick around for bigger reasons.
i was unclear whether or not you are trying to sue your friend or the other drivers, if it was the other drivers suing might not be the best course of action and just collecting enough from their insurance to pay your hospital bills might be another route. as for your friend, i would sue her, she was driving an uninsured car, got you into an accident that left you pretty bad off and she bailed when you needed her.
since she went to the hospital with you there is evidence.
contact the police.

starlight
there isnt much you can do then is there? i dont see point in speaking to the boyf because if your mate has bailed on you he will aswell, and as he wasnt there.........

unless you can prove what happened you could take it court yourself, otherwise yep your screwed

♥*♥Just my opinion♥*♥
Contact an attorney.

If the police were at the scene, which I would think if you injured, you can get a police report from the police station.

But I'm from Indiana, and if you are in an accident without insurance, you are automatically at fault regardless of the real situation. That's the punishment for not carrying insurance.

But you best bet is to contact an attorney, they would be able to help get the answers you need.

Police automatically respond to the scene of a car accident where an ambulance is called, so I don't believe for a second that there was no police report. I would contact the police detachment nearest to the accident scene and enquire with them if any of their officers responded to the accident. If they did ask about how they would get a copy of the police report.
Are you under 18? Is your friend? If yes to both then I would get your parents to contact your friend's mom and tell her if she does not start being co operative she's making a bad situation worse. If your friend is over 18 then I would tell your friend's mom to stay out of this because she is making things worse for her ADULT daughter by trying to hide her.
At this point you (or your parents) should be contacting a lawyer as it doesn't seem like anyone wants to look out for your interest. I would do this as soon as possible as it would seem like the lawyer is going to have quite a bit of work ahead of them trying to figure out who is going to owe you what.

you are probably screwed. No police report..no report of anything happening or who was to blame. You should ALWAYS get a police report...ALWAYS! No insurance...no money.

This is an attorney online free of charge...and you get an answer in minutes. Ask him.

I hope you can find some relief from pain and bills . Sometimes when we do something we have to take responsibility for it too. You got into the car and trusted them..and sometimes things just happen and it is no one's fault.

I am not being mean...I really feel for you. I hope you are ok and will not have years of problems from this and this online attorney can help you.

Usually no insurance is not good...she might be liable for driving without that. At least get her license suspended. In Ohio you cannot drive without it or you are in deep ca ca

Even if the owner of the car had no insurance, if your friend who was driving had car insurance, her insurance will possibly cover you as the passenger, but it depends on her coverage. You MUST get in contact with her.

I'm not sure why your friends mother is cutting off contact with you, it is probably because her daughter is on her auto insurance and the mother doesn't want to be sued, by you. Contact a lawyer. I am assuming you are over 18 and since you are planning on suing for medical bills, you should contact a lawyer anyways. They will determine if you are eligible to sue, not everyone involved in car accidents can sue for medical damages and bills. Also, typically lawyers who deal with injury suits are paid nothing unless YOU are awarded damages, and they take anywhere from 30-40%. If a lawyer wants money up front, find another lawyer.

The police are probably not going to give you the police report, this is common. That is why it is so important to get a lawyer involved, ESPECIALLY with injuries and when you have no insurance.

As you were a passenger in a car , your first action is to make a claim against the driver (your friend). They would then normally send your claim to their insurers and it would get sorted. As you say your friend was driving without insurance you still have to claim against her she will then have to settle the claim in the best way she can. It makes no difference who was responsible for the accident.

Friend or no friend that is the real world and she obviously chose to drive uninsured.

It depends on what state you live in and how their insurance works.
If it is a "no fault" state there isn't much you can do on your own. I'm guessing you would have to talk to a lawyer and ask them what your options would be at that point. You can get a free consultation and if they think you can win they will usually take the case and get paid from your settlement at the end.

If it is not a "no fault" state you can go to the police station that was on the scene and get a police report. You will have to pay for it but usually they aren't too much 5-15 $ depending on police station.
The insurance of the driver that caused the accident would be liable for you.

I agree with the other answers. If this was such a major accident, there should be a police report. If there wasn't, your friend is in very much trouble for leaving the scene of a major accident. You really need to contact the police department that responded to the accident and get a copy of the police report. If there really is no police report, the department who should have responded will be very interested because it is very illegal to leave the scene of a major accident without calling the police. They will investigate.

You really need to speak to a lawyer. A lawyer will have the resources to track down this person, even though they changed their telephone number.

However, you still may have a problem. The type person that commonly drives around without car insurance usually doesn't have very much money.

You can sue them in court, and you will most likely win. But if this person does not have the resources to pay it will be a hollow victory.

Sorry for the bad news.

I know that your friend doesn't want to get involved. It is something however that she really doesn't have a choice with becoming involved. If her mother won't let you talk with her, then you need to consult with your insurance company, or you need to consult with a lawyer.

The lawyer is generally free the first consultation and that is something that you will have to do in order to get any information. They might be able to phone the phone company and request the number of the friend. They wouldn't be able to give you the phone number, but they would be able to give them the number to communicate only.

Chances are, is even if you were going to the hospital, the police would have still had to do a report, because whenever there are injuries there has to be a police investigation, especially if the ambulance is called to take people to the hospital.

You should call your local police department or the one that would have been responsible for attending the accident site, and you should see if they have a police report for the accident.

One Day
If she has insurance her insurance follows her to the car she drives so her insurance company can pay for the bills if you file a claim against her. If you have insurance and you file an uninsured motorist claim they will pay, call your insurance provider and find out.

You can always take them to court to pay the bills too

If the police were on the scene then there has to be a police report. I suggest you start by going to the police department. This sounds like a very sticky situation, and it's sad that your friend won't talk to you. That makes me think she knows she's in the wrong. I hope you feel better, and your friendship will be resolved. Take care.

First of all if your friend still lives with their parents and they are over they are under 18 parents are liable and possible could sue homeowners insurance for irresponsible usage of their vehicle..
Second of all if they are over 18 and live under the same roof as the parents and the parents do not have them listed on their insurance they still are responsible unless they signed a form with their insurance waving the child as a driver. Which again would still place them in a position if they have Uninsured Motorist coverage to extend benefits to you.

Thrid of all if you live with your parents or you have auto insurance or your parents have auto insurace your policy is responsible for your personal medical bills this is call PIP insurance if you live in a NO FAULT STATE.. You can research this with an Attorney in your area as they will give free info to you as I am not that familiar with States that do not participate in the NO FAULT law.

Fourth of all with the serious permanent injury that you have I would seriously look into hiring an Attorney and get with your parents if you are under 18 or even over 18 if you live at home so that they can assist you. Your friends parents wanting to avoid you and not assist you with information is a simple sign that they know they have available coverage for you and are neglecting to provide it to you. An attorney can fill out forms and submit it to them and their insurance company as well as their home owners Insurance company.. That should light a fire under their azz...... GOOD LUCK!!

Sue your friend - she was the driver of the car you were in!

It is very difficult for me to believe that there could have been such a major accident and the police were not notified. If the police were involved and you just didn't get a copy of the report you only need to contact them and they'll send one to you.

If everyone just left the scene (if, for instance, all three cars were involved in some activity where they didn't want police involvement) without exchanging information, then you are pretty much screwed. If there is sufficient documentation of the accident (like at the hospital) you have have action against the driver of the car you were in - and then that would ripple up to the insurance company of the owner of the car.

I find it hard to believe there was no police report at all for an accident that was so serious that someone broke their leg. There must have been severe enough damage to the cars involved, that at least one or more were inoperable. Something like that usually involves a tow truck which will not remove the vehicles unless there is a police officer present to document the accident.

Most likely there really was a police report taken, but you were not given a report case number.

You might check the police department where the accident happened to see if a report was completed after the accident by any party to the accident, then you should be able to track down the party at fault and their insurance.

Otherwise, your only resort is to sue the driver of the car you were riding in...which of course, is your friend.

If you chose not to do that, then you could claim your injuries on your own health insurance. There's nothing else you could do, if you and your friends don't know anything about the driver(s) of the other cars.
