wow, I thought America had an exclusive on the "NOT MY FAULT" defense.

After all, why take responsibility for your own actions when there's somebody else you can blame?

Sorry, enough of my rant, here's the answer to your question:

There's only one way to convince your insurance that the wreck was not your fault:

LIE your bum off. Tell 'em the guy suddenly switched lanes before throwing his brakes on. It's the only way.

Very common kind of accident. I did the same thing a long time ago. It is your responsibility to ensure the road ahead is clear - sometimes it's difficult. 'fraid this one will be judged your fault by any insurance company, unless the guy in front cut in too close in front of you and immediately braked really hard from high speed for no reason (some scammers do this on motorways to claim on your insurance.)

Don't bother phoning your insurance company. You are 100% to blame. If you feel HE shouldn't have moved WHY did YOU move. Just put up with it and next time leave enough room so that if the car in front of you moves, and you do you still have enough room to SLAM on your brakes ( use a spell check).

Hi, I am a driving instructor so can help you. Unfortunately what you have said, the insurance company may say it is your fault by saying that you were driving too close to the vehicle in front and not being observant enough. This is only a possibility but something that may be bearing in mind is to email the highways agency and ask them if they by any chance have any cameras focused onto that particular roundabout which would hold video evidence of the incident. The problem is with claims like this in today's day and age is that you need either eye witnesses or camera footage to back up your story. Good luck.

I am afraid you are at fault in the eyes of the law, even though you dont feel this is true. My hubby hit someone on a roundabout as the car in front pulled out and then stalled. My hubby went and ran in the back of her and was blamed even though she stalled on the roundabout.

I don't know how else to tell you this, but he pretty much as you buy the coin purse if you know what I mean. If you're behind someone and your front collides with their rear the only possible way it cannot be your fault would be if they backed into you.

It may sound ridiculous, but he can say that he thought he saw an ant approaching his front tire, not wanting to kill it he slammed on his brakes. Regardless of how erratic he may have been driving, you were behind him. As long as he did not back into you, it is a slam your hands down on the table done deal. You were at fault. It's OK, don't sweat it. Someone has to be and unfortunately this time it's you.

It is not clear if the other guy was changing lanes or going to. Did he have a change of lane blinker on? Did you make an unsafe lane change? I am not trying to change your story. Just to get it straight.

The other thing that may matter is that he just stopped his car out of now where because traffic was clear.

But if you are behind this guy you have to keep your distance and that is what makes you at fault. If you keep your distance, then you would have been able to stop in time.

Hello,I am Don an old and much travelled ex trucker. One must be careful when saying that ??
To continue,your having struck the vehicle in front of you on any highway,makes you liable and the driver that is in the wrong.The highway code says that one must drive in such a manner as to be able to stop in time and in a safe manner. Had the vehicle in front of you struck the vehicle immediately in front of him,and you then had struck the vehicle in front of you that had struck the vehicle in front of him,then you both would be responsible for striking the vehicle in front of each of you,and so on in a muliple accident the only exception would be when you were shunted forward by the vehicle following you after you had come to a halt without bumping the car in front.in that scenario the car striking you would be responsible for the damage to the vehicle in front of you. Sorry this is not what you wanted to hear ,but it is a warning ,and thank heavens there was no damage done to any person in the accident. Bye Don

Tell it like it happened, BUT.. if you go into the back of someone no matter what they did (unless reversing into you) you are automatically at fault that is the law i'm afraid.
He may of done this deliberately as there is a growing trend for drivers to do this for compensation. Keep your distance is my advice.

I'm afraid the accident is your fault. He was stopped, and you hit him. It was avoidable - you assumed (wrongly) that when he moved forward he would enter the roundabout. You did not allow for him to change his mind, which you should have done.

If he had reversed into you it would be his fault.

Yes, I'm afraid it's down to you. It's always held that the driver behind must drive at such a speed and distance that he can stop safely in the distance he can see to be clear.
