I was involved in a car accident yesterday involving a left turn into a shopping center from a busy intersection. I pulled up, waiting for a clearing so I could make my turn. Traffic failed to slow down, and the light started to turn yellow. I'm already in the middle of traffic, so I turned just as the light was about to turn red to clear the intersection. Well, the car in the farthest left lane (from my point of view) was about 15 feet away when the light turned red, and she sped through the red light at about 30 miles or so an hour just as I'm turning. She hits my car straight on, causing my airbags to deploy and an injury to my arm, face, and neck. I'm put in an ambulance as police arrive and my car is taken away, so I have no idea what the police and witnesses are talking about. Even though my arm is killing me (and still is) the whole time I'm worried about who will be found at fault. She ran a red light, but I feel like I turned at a time I wasn't suppose to. Thanks in advance... Additional Details She also mentioned that something was wrong with her brakes. Could that help in finding her at fault?

It's your fault. If the light was red, you both ran it. In that case, you were the one to pull out infront of her. |

all the insightful answers aside...you need to look at the police report....do you really think she told cop she ran a red lite??? ...how could you know what her light was doing...you pulled in front of a moving car....keep your mouth shut until your ins co tells you whats what.... |

she was at fault. you had the right of way, and she ran a red light. and yes if something was wrong with her brakes, they could say she failed to properly maintain her vehicle and that caused a car accident. best of luck to you! |

She hit you, right? She is at fault.
If you hit her, you are at fault.
Both of you were WRONG. You didn't admit guilt/fault did you? Don't do that, ever.
Her insurance company should pay for everything. Get medical help, and be sure you don't have permanent damage to your back and neck. It could bother you your whole life. Arthritis, nerve damage, severe pain, etc.
Fight, if necessary.

It's yours! I've seen this before (happened to one of my friends).
When you saw yellow and you were in the middle,light changed in red , you made a quick left turn. When that light turned for you in red , because is not a major intersection where they have left and right arrows,You were turning in shopping center, the other person who was coming straight had green. It's true. The other car never slowed down , but he ran on green. That makes your fault. Or unlucky. |

I'm afraid that you are getting a lot of answers from people who aren't claim adjusters. I think one person said it was your fault as anybody turning left has a greater duty to make sure it is clear to do so.
If I understand your description correctly. Both cars are on the same road but heading in opposite directions. You are attempting to turn left across the path of oncoming traffic. You have a legal duty to make sure that every lane you are going to cross is clear.
If the other car had a red light then you also had a red light unless you were in a left turn only lane with a green arrow (but you don't mention this so I assume this was not the case here)
No matter if both cars have green, yellow or red lights in your situation as the turning car you have to make sure it is safe to make the turn. You rushed it and it wasn't clear. We all have done it. If you saw the other car approaching the light and assumed they would stop that is also a big no-no and you will get tagged for some negligence on that too.
With all that being said you may not be 100% at-fault. Depending on the impact point and what state you are in, the other car might get tagged with some negligence too. But you are more than 50% at-fault so your insurance will end up paying the other driver for their damages.
Hopefully, you have medical payments or PIP coverages to pay your bills.

The fact that she ran the red light is going to be hard to prove. If there are cameras in the intersection then you might prevail. Otherwise it's her word against yours and witnesses testimony.

You need to get a copy of the police report as soon as it's ready. If she ran a red light, she is at fault but you better hope the witnesses agree with you. |

ok, it was deff her fault, because you had to clear the intersection. if her brakes are bad she should have braked earlyer sense she new they were bad. she was probable trying to make an exuse. how are you typing if ur hand hurts?

Generally, when there is any doubt, the person that runs into the other person is at fault (so this would be the deciding factor even if the red light part of it couldn't be proven). You were all ready in the intersection before her.
Now, when it comes to insurance, many States are "no fault" which means you pay your expenses and the other driver pays theirs. In those cases, you may have to sue in order to have them pay your damages.

Unless you were in a protected left turn lane (one with a green left turn arrow), you never have the right of way when turning left. You are both at fault. You assumed the other driver would stop, and the other driver failed to stop. You should not have already pulled into the intersection before you could complete your turn. |

If she mentioned that something was wrong with her brakes, she essentially admitted that she should have stopped but couldn't (read didn't). Therefore, she is admitting it is her fault, weather her brakes were ok or not. Furthermore, if a witness saw what happened, and there was that much time between the red light change and your accident, she will be at complete fault. She broke the law, you didn't. That simple. Besides the fact that she admits it.
Relax, get better, talk to a lawyer, and DO NOT SETTLE with any insurance company. They will show up with a settlement very quickly, DO NOT ACCEPT IT. You could sign away potentially hundreds of thousands of dollars for a measly few grand! Talk to a lawyer first (they wont charge you any money until you win!) |
