While I was away on holiday, a neighbour crashed into the back of my car. Some other neighbours witnessed this and came out to speak to him - so when we got back we heard the news from them first. The next morning as we were leaving for work, he came across to speak to us, and admitted liability. I said I would get the car checked over and let him know the score.
Since then I have tried to get his insurance details from his partner, who was not very helpful, and said she didn't understand why we were involving the insurance company as it was "just a scratch". The bumper is scratched but more importantly, my car's engine is in the rear - so it could be damaged I have tried calling on them a couple of times and although I know they are in, they will not answer the door.
I suspect they are not insured. but I don't want to proceed with a repair on my own insurance. Can I file a claim with just their name and address and witness statements? Should I involve the police at this stage?

I would involve the Police as they have already broken the Law by not reporting the accident within 24 hours. |

you can call the police but if its after 24 hrs since you were informed they may not bother, however if you tell them he may not be insured or taxed they will get involved. Just give your insurance company a call they will be happy to advise you and these days all they need is the number plate to capture him. hope this helps |

Your insurance company will confirm whether or not the car is insured, I would tell them if they do not supply the details you will report them to the police!!
And if they haven't got insurance at least they will get in trouble for driving without it the idiots!!
Find out where you stand via your insurance company cos they are just trying to avoid paying up!! |

I'd say to get an estimate of a new bumper if needed at least and then tell your insurance company!
oh, and just wait for them until they go to walk into/out of their house, they cant just run away! |

If he has been in a collision with your vehicle he is legally obliged to supply the details of his insurance company. Speak with the police and ask for their advice. |

first of all, file a police report, have them talk to all witnesses, if the damage is usually over $500, the police will then obtain the insurance information from the individual at fault. if this is not to your satisfaction, file a small claims court case against them. Should they not have insurance, and cannot provide the police with proof of insurance, they can even loose thier license, and will not be able to get it back for up to 90 days and have to prove that they have obtained coverage. You might want to have a nice conversation and state these facts to them prior to calling the police, might be enough to get them to come forward with the info |

You can't make a claim against his insurance company so the next step is to issue proceedings in the County Court for the damage that your vehicle has incurred. (assuming youdon't have comprehensive cover). If you have comprehensive cover it is usually best to get your insurers to pay for the damage and then recover it from the other person - you will have to recover the excess yourself.
In any case you must advise your insurance company of the incident (policy conditions) |

Report the incident to the police (with witness names and addresses) also report to insurance compnay. If this fails, chuch a bo*dy great brick through his windscreen and all other windows. Job can be done for you at a reasonable cost thereby absolving you of all responsibilities and if you have an alibi, so much the better !! |

Just contact your insurance company that is what you pay for they will sort it out for you and you get a reputable repair.
I am always amazed that people don't claim as they should when insurance is so expensive.

In law it is not necessary for your neighbour to report the incident to his insurance company, or to the police, if no one was injured. However, it would be better if you reported it to your local police station, to establish your bona-fides. You then need to sue your neighbor, in a civil action. Request a written statement from your neighbors, and tell them what you mean to do. If you have a small claims court, usually for claims under £1000. it will only cost you a small fee to take an action against your neighbor. When he receives an official summons from the small claims court, he will have to take some action, and probably will settle with you before it costs him any more expense.Good Luck. |

I would take it to a garage and have it checked over (possibly by the AA). Then get quotes from a couple of reliable garages and let your neighbour pick up the tab. No need to involve insurance if it can be fixed at a reasonable price. |

get a quote for the damage,,see your neighbour and say thats what it will cost...see the reaction....have a photocopy to give them....and hopefully they will pay....keep it on friendly terms....if they argue.then fall back to the position that you wil ldo it on your insurance but they must pay your excess..then they have no real argument ...you l assume have informed your insurance company...if not do it now.... |

Drop them a note saying that if they don`t supply their insurance details you will have no option but to inform the police. Sounds as if they do not have insurance.
It won`t do a lot for neighbourly relations, but they are being unreasonable in their attitude. |

If the accident was in the US (are you in GB?) and happened in a private property, the authorities would not issue a ticket. You will have to have your insurance company pay for it and afterwards, you could sue them in small claims court. |

get a quote. ask him to pay. dont involve insurance.
if he does not pay. take him to small claims court.until you have got a quote for the damage not a lot you can do.
if it is in fact a scratch the costs may be minimal and it is possible your neighbour will pay you straight away.
post the quote recorded delivery with a request for payment.
involving the police will not be any help to you at all. they are not not going to get involved in civil actions because that is bascially what it is. up to now no offences have been committed.
you only have to report a accident to the police within 24 hours if personal injuries have occured so no offence. |
