Your insurance co. is supposed to help you with this. Ask them. If you can't get satisfaction from them, that's when you sue, using one of those attorneys that advertises on tv - "Hurt in an accident? Call me!" |

It depends on the laws of your province/state, but generally, if you dispute each others account and there are no witnesses, your insurance companies will investigate. They may choose to split the liability 50/50, in which case, you will likely both see your premiums increase. Typically, however, when one person is rear-ended, the other person is found at fault. over here anything comming of your right has right of way if car that hit you is in your bodywork and not other way round (your car in theirs) then the other driver is at fault . i would presume that same law is also in effect .
best thing to do is contact insurance company explain what happened they will be able to advise you more clearly
could be a case other driver was unfit to drive or is trying to scam you . |

well it depends. If someone hits someone from the back the person that makes contact with the back of another car is their fault no matter what, did u run a red light or stop sign, if so it would be your fault, if they did it was their fault, need more detail really to answer better. |

i had this same thing happen and i had full coverage insurance with nationwide. the lady behind me rear ended me and due to bad weather, no report was filed. the lady made up some dumb story that didn't even make sense and my insurance wouldn't do anything about it and we both had to pay for our own repairs to our vehicles.

If you have to go to court then just tell them what happend. I was in an accident a few years ago, I had the green turn arrow and some dumb*ss ran a red light and hit me! I ended up getting a ticket and having to pay even though HE RAN THE RED LIGHT. Just stay calm and tell them what really happend. |

The insurance Company will work it out. I might call them and ask. You want to make sure you try and win. You can also obtain a copy of the police report from the police station. That usually has a big idicator on the outcome. Even though the cop didn't write a ticket, i am sure his report is bias.

No police report will more than likely make it a no fault situation. Why were the police not contacted if there was damage to your car? Unless you live in one of those states that do not have no fault insurance, then you will probably be in for a long battle with your insurance company and his, if you bothered to get his information. |

It doesn't really matter what either of you said, or whether or not tickets were given. The two insurance companies will discuss it, investigate it, and come to some conclusion. When they do, they will let you know if you are getting, or paying out. Left rear might mean you turned in front of him, or it may mean he ran a red light. I wasn't there to see it.
Added: For those of you saying "His fault". Left rear is not from behind. Left rear is the left SIDE of the car towards the back.
Added again: He also didn't say no police report, he said "No tickets given"--big difference. |

First of all calm down, you have no reason to worry about who is at fault if you have insurance.
If you don't have insurance but the car is insured in someone else's name, your covered!!!
If you have no insurance contact a lawyer so an investigation can be started right away, don't wait!!!.
Full coverage pays for yours and his damages.
Liability covers his damages only if they find you at fault but your on your own for your damages if thats the case.
Insurance does investigate and it's possible for them to find it no fault accident meaning they don't know who was at fault so your ins co pays for your cars damages and any Dr's bills you may have, and his ins covers him in the same way.
He can also file a lawsuit on you personally but if that happens you call your insurance company first before calling anyone else. This happened to me cause my father was in an accident in my car. No cops were called she said she was not hurt and there wasn't even a dent on her truck tho my headlights were busted out. They traded insurance information. It's the law in Maryland to call the police if there is bodily damage meaning you need to go to the hospital. My ins refused to pay the woman because her big old truck was not damaged and she said she was not hurt, did not call the cops or an ambulance. 2 1/2 years later she filed a lawsuit on me for $30,000. I called my ins company rather than calling her's like the papers said to do. And before it went to court my ins company settled it out of court. It is their job to protect you. |

In almost every case of a rear end collision, the driver that did the rear ending is responsible.
Unless you cut him off or were backing up and hit him. If one car is going in reverse then that driver is responsible pretty much every time. |

If you've been hit from the rear, most insurance companies will side with you, unless you were changing lanes during the collision. The stance of the insuarance companies is that it is the responsibility of the driver in the rear to leave sufficient space (2-4 seconds) between the cars while driving.
To be safe, I would take your car down to the police station and file a report. Usually, if there is more than 1000$ worth of damage done, a police report is required. The report will document the damage and make it easier for you to back up your claim. |
