theoretically you are supposed to always be in control of your car... also if the driver going 60 (opefully the speed limit) hit his brakes then there would be skid mark patches that can be analyzed. If there was no attempt to brake made then it is the oncoming driver's fault, otherwise it is the stop sign guy's fault. |

the one making the turn, who happens to also have a stop sign. That being said, there could be a factor with the speed of the other car. However, the person at the stop sign will always be in the wrong, because you can't move until traffic permits. |

If the car had a stop sign, and failed to stop, or did a left turn in front of another car (assuming driving on the right hand side), regardless of whether there was a stop sign in front of them, the accident would be the fault of the turning car UNLESS they had the traffic lights indicating a green left-turn arrow. In general, the car that is turning must always give way, unless they have a green light specifically for turning purposes.

Depends on the situation. Normally driver 1 who had the stop sign would most likely be at fault since he had the stop sign. and since driver 2 had no stop sign he had no obligation to stop. However if driver 2 was exceeding the speed limit he could be held at fault as well. But normally it would be driver 1 at fault. It takes too long for the brain to react to movement when a car pulls out in front of another car for the driver to stop and avoid them unless you have taking defensive driving courses and then it becomes habit but thats not the typical situation. |

The car at the stop sign. To my knowledge they should give way to anything already travelling on the road they are turning into, if it is a side street to the main flow of traffic or a T intersection. |

Although if the person going 60mph was speeding the person with the stop sign could go to court and try to prove that had the person been going the speed limit he would have had ample time to make his turn. |

The person that had the stop sign. If they were going 60, they wouldn't have had enough time to stop anyway, but that person could still get a ticket cuz they might be going too fast past the speed limit. |
