At An Underage Drinking Party...?

If I'm at the party and I do not drink at all and say a cop comes in and everyone gets busted. Even though I'm not drinking, would I still get my license suspended until I'm 18?

im not sure if youl get your license suspended...but you will get in trouble.

If you are not drinking and cops come in you should be okay, but they are also cops and they will probably write you up regardless.

Ditto.

no you shouldn't, but you may get in trouble for being there.

Marisa
No, if you weren't drinking than you can't get in trouble. Cops can't bust you without proof. They will do a blood test or have you walk in a straight line to see if you are drink or have been drinking. I wouldn't go to an underage party where alcohol is, because things can get really sketchy when they drink underage.

No, but why go to an underage drinking party and not drink?!

I don't think so.. if you are not drinking, then you are safe.. The owner of the house will be the one busted, and the adult will be charged for giving drinks to underage..
I have been at underage drinking party when I was underage, cop almost busted us.. some neighbors called on us for loud music, so when we saw cop outside, we all ran into one room, all cramped up and stayed quiet when only that house owner and his girlfriend in living room and apologizing to that cop.. and that cop left.. we all was like WhEW!! we don't only have beers, somebody also got the greens.. thank goodness.. but fun memories.. maybe your party will get lucky too.. But I wouldn't drink if I were you.. it's more fun just to watch others get all drunk and act all dummy..

Luke
No because you're not drinking, and how are the cops supposed to know that you know or don't know that it was an underage drinking party. What if you're ignorant of that, or you just didn't know?

If you're NOT breaking any laws yourself, I don't think you should be held accountable for the actions of others.

You're not in the same CAR as them, you're in a house. In a car I'd imagine you'd have more problems than in a house.

If they get busted, but you're underage and not drinking, you'd be totally fine. And you can always claim that you were in a nother room, didn't know, didn't care, whatever, I mean how would they know?!? They wouldn't, and cops busting you on that would have to mean that you'd get a ticket or a complaint of some sort, and you CANNOT, I repeat, CANNOT get a sentence for doing something that someone else did. And I don't believe that they give tickets/complaints for people busting them for just being at a location where things were going on.

For example,...I got busted smoking/drinking once when I was with my friends DURING SCHOOL, yes during school what an idiot I was,and we were all smoking and drinking, but I was the one holding the liquor bottle and seen smoking the cigarette so I was the one that was suspended from school and got in serious trouble.

They didn't test the other two for alcohol and they couldn't prove that they smoked.

Basicallly whoever the cops see as visibly drunk or are drinking there at that time they walked in would be busted, and the others even if they DID drink, but appeared normal or somehow hid it, unless the cops did testing, couldn't be proven that they were drinking.

Then they'd ask whoever owned the house, or rented it or whatever, if they were aware, and who bought the drinks.

There are alot of factors that go into it but technically, it's not as easy to bust as you'd think, unless they REALLY were hellbent on trying to get you.

Also that's considered underage drinking at a residential area, NOT underage drinking in a vehicle, business, school, or restaurant/bar, etc,...which would be MUCH more serious, especially for the owners, or people in charge of those places.

Being at an underage drinking party, which is something I did alot when I was younger, isn't the most serious thing to worry about getting busted over.

Honestly, if you're gonna do it, you're gonna do it, no cop or authority can stop you, so HAVE FUN! DO what you want as long as you know the consequences, and in this case,...

they're really NOT that major, it could be ALOT worse.

I still am not saying it's totally okay but let's face it, it happens, and worse happens. Prostitiution, drugs, etc.

So if ur gonna do this, believe me,

its NOT THAT serious.

If you're just worried that you'll get busted because you're totally innocent, but other people there are guilty and you don't want to take the fall with them...then don't worry about it.

You simply didn't know what was going on, or didn't care or it wasn't any of your business. It's THEIR problem, NOT yours.

Even if you were aware, it's THEIR responsibility, NOT yours.

Especially if it isn't your house!!!

that's like saying I'm at someone's apartment playing nintendo, and their like brother is in the bathroom snorting drugs and teh cops come and bust him and then bust me too. That can't happen! I didn't do anything wrong, wasn't aware....they can't do that to innocent people.

So if you're innocent here, you're fine.

you are still going to be in trouble because you didn't report it to the police and you were aware that it was going on.
sorry, its rough

swimma
they cant suspend your liscense. were you driving? and you can say in defense i just got there to pick up my friend. as long as you have no alchohol on you, youre fine

pinkkandyangel21
but usually at a party, if there's to many people they wont do anything, they will just warn you and if they have to come back your in trouble.

mtchndjnmtch
no.

Nope, if you aren't drinking then you're safe. But it might be a good idea to stay away from that kind of trouble if possible.

Water
No, they will prob ask you to take a breathalizer (sp) test. When it is ok then you will be fine.

Laaaauren :)
nope.

tnuc_denots_gnikcuf

what would they bust you for? you're not drunk, you could conceivably not know the age of the drinkers at the party, so you might not even know a law is being broken.

Laws vary from State to State. as for Michigan and/or Indiana, No if you have not been drinking and your BAL is 0 then you have NOTHING to worry about charges cannot be brought against you.

you arent doing anything wrong but there still will be drama. Like you will have to possibly go down to the station or they have to test you if you have been drinking i dont know you might get busted or you could run hahahaha.

If you have genuinely not been drinking, you can ask to be breathalysed- and whilst that's not 100% accurate, it would certainly stand in your defence for appealing any ban placed upon you.

In the end though, if you do nothing wrong, you should be fine :) Just enjoy yourself, the cops aren't all that bad.

No you would not. Believe me, I was at many parties underage that got busted and if anything only got a MIP...you're cool. Have fun!

If you aren't doing anything then you can't get in trouble. I wouldn't risk it though

ferretguy5
Yes, if you are the oldest at the party, you will be charged with furnishing alcohol to the minors. Whether you did or didn't irrelevant.

justasmalltowngirl
No, they can't give you an alochol charge unless you are actually holding alcohol or if they give you a breathalyzer. But, if you were not drinking you would pass the breathalyzer. You should be good.

If your not drinking you should not get in trouble, but i wouldnt want to put myself in a position like that.

Dr. Feelgood

As long as it's not your house and you're not drinking you cant be charged with anything. In fact you may be congratulated if you say you was gonna be a designated driver. But yes they will probably handcuff you and give you a breathaliser.

You're not breaking the law. BUT, if the cops think you might be, you still risk being arrested and questioned.

no but just so you do know if your smoking weed or any other drugs and if they can tell that you are indeed on something some state its a felony to ingest digest consume any narcotic just so you know and also if cops know that their is any underage drinking going (usually they find out by narks that get pulled over by cops and the cops scare them by telling them their going to go to jail) they dont need a warrant to bust down the door and for you if the cops want to be ***** you can get a party to crime fine please rate this answer

oriolesfan2323
No. If you don't drink, then you aren't breaking the law.

As long as you are not in control of the house, you will not be charged if you are not drinking. The person in control can be charged for providing and allowing the drinking.
