Can I get arrested for talking trash to a cop?

When my brothers PO comes over tomarrow I wanna talk trash to him. Can I get away with this? I'm squeaky clean.

Yes. In fact, there is nothing a cop can do if you talk trash or threaten him/her. Also, A cop is required to wait until after a citizen punches or kicks him/her at least 8 times. Sooooo...if I were you I would talk all the smack you want and then drop kick him 7 times and you should be in the clear.

It depends on what country you are in. In the United States, you are granted the right of free speech, so as long as all you do talk, then legally there is nothing that he/she can do.

There have been court rulings to back this up. Verbal abuse is nothing more than an occupational hazard for a police officer.

Now, having said that, I will say that I have seen more than a few police act outside the law. The power that a police officer is given can easily go to their head, and give them a false sense of entitlement.

So, if you mouth off to an officer, and they decide they don't feel like taking it, they could do anything they want, and at the end of the day it's your word against theirs. This is a fight that is nearly impossible to win.

Therefore, just because you can technically do it from a legal standpoint, it does not mean that it is a wise course of action to pursue.

If you are squeaky clean and want to remain so I would not bother talking trash to a cop. If you antagonise a cop you will not be very popular. If you expect a cop to be fair to you, you should be fair to the cop.

Rather depends on what you mean by talking trash. There is no statute that prohibits "talking trash" to a PO. There are other laws that can be committed in many ways. Interfering with the duties of a cop, threatening a cop, refusing the lawful orders of a cop, etc. As to your specific question, yes you can be arrested. Whether that arrest is lawful and can lead to conviction of a crime depends on the laws of your state and country and exactly what you did.

Yes, you can be arrested. If you interfere with his duties, you can be arrested for obstruction, which is a misdemeanor.

That's the technical term for 'contempt of cop.' ;-)

It's not worth the bother, you'll just end up looking like a twit, and your squeaky clean record will go out the window.

Your brother's PO is a Probation Officer. Not a police officer.
A probation officer has a lot more lee way when it comes to what he can do to the person on probation.
So if, because of your actions, he wants to he can start to violate your brother's probation (put him in jail, no bond). He can also decide to drug check your brother on a daily or even hourly basis, coming over to your hours whenever he feels like 24/7.
He can also see the judge and get an order to drug check everyone that lives with your brother (like you and your mother, for example, because of the influence they may have over him.

So do what you want and let your brother suffer first and your family later.
