If you're drunk in public but are not driving, can you still get arrested?

Just wondering if a police man can arrest someone who is drunk in public but is not driving a vehicle. And what reasons would the officer have for this?

It depends on the laws where you are. In the town closest to us, there is a law against "public drunkeness" and people do occasionally get arrested for it.. it is usually used to arrest people acting up in bars, but they also can get you on the street.So public drunkeness is really a common thing you can get a misdemeanor for.

This depends on state law, but many states allow arrest for "drunk and disorderly conduct" (public intoxication). If you are damaging property, endangering others or being a nuisance, you could also be arrested and charged with other crimes.

Yes you can get arrested for public drunk or disorderly conduct. You cannot be drunk in public!

Public intoxication or if ur being loud it can be disorderly conduct while intoxicated. Anything to make you pay a fine and imbarrase you.

Check your local laws, but I'm pretty certain that public drunkenness is against the law just about everywhere except maybe Las Vegas.

Yes, public intoxication is grounds for arrest, unless it's the result of medical treatment.

unless there is an ordinance that prohibits getting drunk in public you would be arrested. But if there is none, then why would you be? ... but if you commit a (crime resulting from being drunk) that would be another story.

Yes, its called public intoxication. First rule, be happy when you feel the need to indulge in drunkenness. Usually the person who gets "snag ed with the cuffs" for this is obnoxious, mean, abusive,and has a "trash mouth. If you meet the criteria of the last, your chances of waving a red flag in front of a bull would be better.

here its s ticket and a trip to detox. Ticket usually costs $75 and detox $200, often the drunk will fight or resist and that's when the good charges come along.

Yes, it's called public intoxication. Usually it's used when you're being obnoxious or are a danger. Or just if you tick the cop off.

Absolutely - it's called Public Intoxication.

And the cops can use that excuse for whatever reason suits them. Say, you argue with them when you are totally sober. They do not have to give you a sobriety test (field sobriety or breathalyzer). All they have to do is say "you're drunk", and arrest you. Then you get put in the drunk tank.
