Assault is the threat of an imminent battery. Battery is a harmful or offensive contact. To sue in tort..you don't even have to have actual contact with the person..it can be with an object, etc. If you find someone spitting on you offensive, which I assume you do, and if you were placed in imminent apprehension of that...then you have assault and battery. God Bless America, huh? |

Someone spitting on you is considered assault. The actual charge is "assault with Bodily fluid". It's a misdemeanor unless they have a disease of some sorts that can be transmitted through bodily fluids. Then it is a felony. |
