Is someone spitting on you the same as assault?

I spit on people all the time, sometimes even their kids too, and nobody's ever said anything to me about it. J/K

Assault is the threat of an imminent battery. Battery is a harmful or offensive contact. To sue in tort..you don't even have to have actual contact with the person..it can be with an object, etc. If you find someone spitting on you offensive, which I assume you do, and if you were placed in imminent apprehension of that...then you have assault and battery. God Bless America, huh?

Spitting is assault, it's a bodily fluid and it could carry disease or a virus.

Spitting is assault, but I don't reccomend kicking their ***. That just makes you as bad as them, as well as making a counter claim possible. Besides, if you take it too far, you might become the one at fault.

Someone spitting on you is considered assault. The actual charge is "assault with Bodily fluid". It's a misdemeanor unless they have a disease of some sorts that can be transmitted through bodily fluids. Then it is a felony.

The intentional touching of one person by another without that person's consent constitutes a crime ... plain and simple. Spitting falls in that category of "touching".
