Technically yes - but she could also sue you for trespassing and for breaching her human rights - she'd almost certainly win! |

What type of idiotic question is this and what type of moron would even post it?
You are on her private property and what she has there is none of your concern. And I'm sure any lawyer worth anything can drum up a charge against you for being a perverted peeping tom. So I say go ahead and sue. I would love to see you post again about how you lost the case and then was countered sue for trespassing and spying. Good luck. |

Yes, you can sue her for the broken glass if it was put there deliberately to deter burglars or other such criminals. However, you might be prosecuted for stalking which is a very serious criminal offence. Next time just use a telescope or binoculars! |

You could try, but more likely she'd counter-sue and accuse you of Lord knows what.

You may have a case here. Under the Occupiers Liability Act (1995(I think)) all occupiers of premises owe a duty of care to visitors to their land, be they legal visitors or trespassers. In the case of trespassers it is generally there to deter people from setting traps to catch or deliberately harm people, as such you would need to show that the glass was left there deliberately as a security measure for instance.
On the flip side of the coin however, you're neighbour would probably not be to chuffed with you perving on her and may decide to call the police to press voyeurism charges on you and also file a counter claim for trespass, which is actionable perse. On balance I'd probably say let it go........ and get a girlfriend!!!! |

Only in England would somebody think that... |

If you were invited onto her property, her home insurance would cover your medical bills. However, since it seems you were not invited, I wouldn't even try. You'd be heavily fined for tresspassing if nothing else. |
|

Not Your Friend

Oh yes. And sue her for her bad taste in underwear while you're at it. |
|

Big Gascoigne

Depends how fit she is. If she is a looker then you may have a claim. If she is a bushpig then you don't stand a chance. |

Yes but you may not get much if she was down to the bare bones |

Yes you can. It doesn't matter if you are breaking the law. Your neighbour still has a responsibility to ensure all her property is safe.
Its stupid I know, but I am responsible for the safety of all my fields, even if people trespass onto them.
Its OK except I laid 30 bear traps last year and can only find 27 of them. |
