can you sue a parent for hitting you?
Find answers to your legal question.

can you sue a parent for hitting you?

i am 17 years old and recently my dad punched me for no apparent reason in the eye, he is a violent person with low intelligence. I do not know what to do, i do have a little sister and i feel she should not be in this hostile environment, but am i considered at the age to do anything? am i over the age? under the age? i do not really know..

i'm pretty sure that qualifies as child abuse and you should report this to the police immediately.

your under the age of being able to sue your dad but you should tell somebody older then you about it so they can help you out..

well no but you maybe could call the cops.

You are under 18 so it is possible that you could go to a councilor.

You can call the police and have him charged with criminal offense(s).
I don't know about suing though, I've never heard of that in this type of situation. I know people sue for medical bills and stuff like that, also 'pain and suffering' type lawsuits. But generally you have to be 18 to sue in civil court or your parents must do it for you, doesn't seem like that would work in this situation?

I think suing even if it was successful and allowed might also make home life more difficult for your sister? I suggest contacting the police or child welfare services in your area. Legal aid may be able to help with info on whether or not you can sue in small claims court, my guess is no at least not until you're 18.

You are under the age. You could call the police. They can arrest him for domestic violence and give him a battery charge. They will also ask a lot of questions of what happened and why did he hit you (like if you hit him, etc). Sorry this is happening to you. You are almost at the age... take care of yourself and you sis.

User123
yes, and he should be punished but consider the effects of taking it to court on the rest of your family especially your sister...

Bri~Bri
ummm.... talk to your teacher or friends or someone. i think you have to be 18 to sue a person yourself but if an adult helps present your case i think you can....

SonnyF
one I think you're over reacting, two don't sue your parents what you get now is probably nothing compared to what you parents got when they we're your age. So you probably have low intelligence and I'd like to hear both ends of the story 'cuz he probably didn't do that for no reason whatsoever

Core
You can press assault charges.

patience77
you can press charges against your dad for violent assault that he made upon you and have the workers to come out from children services in making sure your sister will be protected also. You have the right to being protected from anybody who assult's you for that is a crime committed by law within itself.

arizzy123
you can call the police and press charges.

You can get emancipated, but since you have a younger sister.. that wouldn't be the best choice leaving her behind. If he really is violent, talk to someone you know, and you can probably have you and your sister moved somewhere that is safe to live.

Well you need to atleast tell someone about this. It's not right for a parent to hit you. I think you need to call national boys hotline. They'll know what to do.

well even if you are over the age your sister is not. so talk o a guidence counceler or an adult or next time you go to the dr. mention it when your dad isnt in the room

I would contact the police. If you wish, you can ask the officer to contact child protective services on your behalf. The Dept. of Human Services is reluctant to investigate reports from the average person, having a police officer contact them may get a response.

My best advice would be to contact a Child Abuse Hot-line. The lines are staffed by well trained counselors who will help you make the best decision for you and your little sister. The number is 1-800-4-A-Child.
They are experienced and would be the best people to have answer your questions.

Please make sure that you are in a safe place when making that call. Perhaps a counselor from school will allow you to use the phone.

I wish you and your sister the best.

Yes you can. Take pictures of your eye and consult a lawyer. You might get taken out of your home though.

Punching you in the eye would be child abuse. So, you could call the police when he does that. I doubt you'll be able to sue him though, if you're living under his roof and under his legal custody.

Although, let me add, when I was 17, my dad slammed me into a wall when I told him to get out (he was drunk, and it was my mothers house). I was sick of his crap, so I called the cops and they told him to leave. That was it. I told the police with my mother present that I wanted to press charges and the police ignored me, I don't know why but possibly because my mother didn't take up for me. So if you do call the cops, have your mom stand by your side if you can to support you.

If he left a mark or a bruise on you, you can press charges for child abuse.

you cant sue but you can press assault charges

Call Child Protective Services and they will send an officer over to take a report. My step father used to try that crap on me when I was 14 but he messed with the wrong kid and let's just say that he only tried it once.
He should have known better considering I was already taller than him.
