I don't know about suing though, I've never heard of that in this type of situation. I know people sue for medical bills and stuff like that, also 'pain and suffering' type lawsuits. But generally you have to be 18 to sue in civil court or your parents must do it for you, doesn't seem like that would work in this situation?
I think suing even if it was successful and allowed might also make home life more difficult for your sister? I suggest contacting the police or child welfare services in your area. Legal aid may be able to help with info on whether or not you can sue in small claims court, my guess is no at least not until you're 18. |

You are under the age. You could call the police. They can arrest him for domestic violence and give him a battery charge. They will also ask a lot of questions of what happened and why did he hit you (like if you hit him, etc). Sorry this is happening to you. You are almost at the age... take care of yourself and you sis. |

one I think you're over reacting, two don't sue your parents what you get now is probably nothing compared to what you parents got when they we're your age. So you probably have low intelligence and I'd like to hear both ends of the story 'cuz he probably didn't do that for no reason whatsoever |

You have the right to being protected from anybody who assult's you for that is a crime committed by law within itself. |

You can get emancipated, but since you have a younger sister.. that wouldn't be the best choice leaving her behind. If he really is violent, talk to someone you know, and you can probably have you and your sister moved somewhere that is safe to live. |

I would contact the police. If you wish, you can ask the officer to contact child protective services on your behalf. The Dept. of Human Services is reluctant to investigate reports from the average person, having a police officer contact them may get a response.
My best advice would be to contact a Child Abuse Hot-line. The lines are staffed by well trained counselors who will help you make the best decision for you and your little sister. The number is 1-800-4-A-Child.
They are experienced and would be the best people to have answer your questions.
Please make sure that you are in a safe place when making that call. Perhaps a counselor from school will allow you to use the phone.

Punching you in the eye would be child abuse. So, you could call the police when he does that. I doubt you'll be able to sue him though, if you're living under his roof and under his legal custody.
Although, let me add, when I was 17, my dad slammed me into a wall when I told him to get out (he was drunk, and it was my mothers house). I was sick of his crap, so I called the cops and they told him to leave. That was it. I told the police with my mother present that I wanted to press charges and the police ignored me, I don't know why but possibly because my mother didn't take up for me. So if you do call the cops, have your mom stand by your side if you can to support you. |
