2 weeks notice. I'm getting ready to leave my job for hopefully a better job. Need some info.?

I'm getting ready to leave the company and I'm ready to put my two weeks notice in. However I can't start my other job until the two week period is up and the company I work for now has a reputation to let you go the day you put your notice in, and not letting you work the two weeks out. Is this legal? I need to two weeks pay for mortgage payements and bills. So, going two weeks with out pay could make things very very hard for me. Any advice would be helpful thanks.

Since you know that let you go once you resign. I will suggest you don't give them your resign and work there for 2 weeks and then give resign of 2 weeks and if your positive they won't give you that 2 weeks

While two week's notice is customary and a general rule, if you believe they will let you go anyway, then don't give them notice. Or only give them a couple of days. The worst that could happen is that you may get a bad reference from them in the future. But if you've found a new job you like and want to stay there anyway, probably not a problem.

Unless you have an employment contract with the company, you don't have to give two week's notice. In the US you are considered an "employee at will", meaning that the company can terminate your employment at any time, for any non-discriminatory reason. Similarly, you can leave the employer without notice. The "two week" notice is a courtesy to the employer that has become custom.

Generally, a company that releases an employee on the day that they submit their resignation will pay for the two weeks.

Notify the new company that you will give notice, but that you may be available sooner than expected. If that happens, will they allow you to start earlier. I'm confident that they will.

Good luck

In most states if you give your letter of resignation and state a 2-week ending period date they have to honor that and PAY you for the 2 weeks - It's the law. Sure they can let you go... BUt since you gave a written 2 week advance notice they would have to honor that and pay you.

Another good idea for the future is to establish a BUDGET for your INCOME and EXPENSES so you are NOT in a pinch with your mortgage and bills.

Good Luck on your NEW job opportunity. :-)

It is not necessary to provide two weeks' notice - it's simply a professional courtesy.

You may want to check with the prospective employer and let them know your current employer tends to walk people out at the beginning of the notice period, and would they want you to start work any earlier if you're released earlier? Some companies are willing to do that.

Otherwise, I don't normally recommend that an employee quit without notice, but in this case it might make sense - just tell them that Friday that it will be your last day. They may be upset, but so what - they can't fire you... :)

You could always put your two weeks in and if they get rid of you today, you could go to one of the temp agencies that hires day workers. You go there and wait and they send you out on jobs (usually in factories - covering for workers that called in). You get a check at the end of each day for the hours you worked.

Good luck! :)

if they fire you make them put in writing why have a tape recorder with you also so yo can get it on record why they fired you then go directly to the unemployment office and sign up for benefits. this will cover the 2 weeks before you start your job. also call the new company and tell them what happened and see if you can start sooner.

WHOISTHEPUPPETMASTER?
If you feel they will fire you if you put in 2 weeks notice....then just leave in two weeks without notice. I'm no legal expert, but no company should be able to fire you for giving a 2 weeks notice.

It depends on the state you live in but most states are at will states and once you submit your resignation, most companies can reserve the right to accept your resignation immediately, without notice. It would be nice if they paid you in lieu of notice but that doesn't alway work out that way. You should check your local laws and company policy also whether you have an agreement of some kind with them. Also, why can't you start your new job sooner? Good luck!

If you start your new job in 2 weeks and you company generally fires you immediatly when you give notice, I'd tell your contact at your new job about the situation.
If your contract allows either party to terminate the contract for any reason at any time, I'd wait until the Thursday before you are due to start your new job. If the company fires you effectivly immediatly, you get a long weekend. If they protest your short notice, simply explain that you didn't want to tell them earlier because of their commonly known practice of terminating employees immediatly.

Make sure that when you give your notice, you do so with a formal letter informing them of your intent to take on the new position.

If they fire you when you give notice just wait until the last day and tell them you are gone. I wouldn't worry too much about a reccomendation if this is how they treat people.

If they have a Rep for playing dirty .....Play there game dont give them notice

I think since you know your old company will let you go too soon, you should work up until a day or so before you quit. Since you already have a new job, you don't need your old company for a reference.

If you need two weeks for bills, you don't need to be changing jobs right now. Instead, if you have vacation or personal leave time, use as much of that as you can to try the other job out. If you don't have PLT, does the new job offer it? If not, you are not getting into a better position.
Giving notice is not covered by most state employment laws. If you are in a union or association or if the company written personnel policy addresses how they will respond to two week notices, then you may have some recourse if the union or personnel guidelines are not followed, but chances are, the decision will have to be made in a court of law. Totally not cost effective to employees.
Loyalty is probably the reason behind companies who don't honor two week notices. Especially if you are going to work for a competitor. A disloyal employee can do a lot of damage in two weeks.
Good luck to you. And, congratulations.
