Have a got a claim?

I was sacked unfairly from my last job they sacked me after they found out I was looking for another job im not sure what I can do as I was only there 9months. P.s they pushed me to look for a new job after a verbal warning for something they fixed to look like my fault.

Yes! that's unfair dismissal.

Get their reasons for dismissing you in writing as soon as you can. You need a paper trail. Also get copies of the warning you were given [I know its a verbal but the still must document it, as ridiculous as that sounds...]

Employers are obliged to allow you to look for other employment, in fact they should even grant you a day's leave to attend interviews.

Are you in US, in which case I don't know where you go for advise.

UK worker? Citizen's Advice Bureau would be my first port of call. Unless you have a union relating to your industry. [call them even if you are not a current member, things can always be done]

Fight this as you are doing so on behalf of all those oppressed by their bullying employers...

Depending on where you live , you should have an office of Labor Relations. It's probably going to be on the state level. I should think that most important of all would be witnesses to either their suggestion that you look for a new job or to the fact that they rigged....whatever.....to make it appear to be your fault.

i think u need to call a lawyer and see what they think. i dont think ur last job was right to fire you just for looking for another job and it def wasnt right for them to frame you for anything to get u fired.

"At will" means that you or the company may terminate your employment with or without notice, with or without cause. Did they tell you the reason for your termination was because you were seeking another job of did they give you another reason? You could try to talk to an attorney about the facts of your case and see if you have anything but it doesn't sound likely.

It all boils down to what you can actually prove i.e. written documents. What you think isn't evidence, and if they gave you a verbal warning be it right or wrong they certainly know the law and would have ensured everything they have done be within the law. Better to forget all about it and get on with your life.

In the UK - no. You cannot take a claim for unfair dismissal to an employment tribunal until you have worked for an employer for at least 12 months.
You could claim wrongful dismissal if the employer failed to give you proper notice, but otherwise, no.

If you had a written warning i assume you had a disciplinary? You have a certain amount of time to appeal against the outcome of any disciplinary. did you follow this at the time? Similarly to sack someone you need to go through a disciplinary procedure. If the above did not occur then you may have a claim. visit your local citizens advice bureau and they should be able to help you

Employers do that sort of thing all the time.
Just be happy that you got out and make a meal of a your new job.

Assuming you are in an "employment at will" state.

You state you were looking for other employment and you employer found out and terminated you. Can't respond to your "verbal warning" because we do not have the facts.

You could file a claim, but based on what you wrote the Company did not do anything illegal.

yes, you can get in contact with you citizins advice beauru, they are not allowed to sack you, if they find out you are looking for a job, it has to be something harse,
you definitly have a case but go to your citizin advice beauru first, i hope you are not missing stuff out, cos if you have it could be a totally different situation, like if you came late everyday, it could change

What was the reason given for termination? Additionally, where are you located? Employment laws are not universal and differ from country to country and in the U.S. from state to state.

Probably not, unless you are represented by a union. Most American jurisdictions follow the "employment at will" rule, which basically means that your employer can fire you at any time, for any reason--as long as it is not a prohibited reason (i.e. gender, race, etc). If you are represented by a union, there is a good chance that your union has negotiation a "good cause" termination clause which means your employer has to have a good cause reason for terminating you. You cannot take them to a tribunal, as you worked there less than a year.

You may be able to claim wrongful dismissal if they did not follow the correct procedures when firing you. Did they give you adequate notice and holidays accrued?

If they didn't, go see your local Citizen's Advice Bureau for more help.
