Additional Details
First, let me explain that I have multiple jobs. Second, I am gay, a male, between 18 and 25, Caucasian, and a citizen of the USA. The job is with a library, and I also work at another library doing the same thing, the exception being that I have hours weekly at the latter library. When the supervisor for the former library was instated, she made a great many changes to the policies and procedures. I made to adhere to them as best as possible, and I also let her know my opinion on some of the changes both positive and negative but always constructive. The excuse I was given was that there aren't any spare hours. This has been going on for almost a year and I don't think anyone else has had the same problem. Also, to clarify, "on the payroll" means I am not getting paid, but I receive the Christmas bonus, and don't need to be reinstated or rehired to work.

No, there are a myriad of excuses to use for your unneeded services. Besides, why rock the boat? You ARE getting paid for NO work. Just make sure that if they lay you off, follow up with some paper trails and legal advice. |

it is discrimination! By law you have to schedule employees to work a minimum of 8 hours per week unless they have agreeded to a non-paid time off.
Get with your local unemployment office and labor office to find out your local state laws. Then go from there you may have a lawsuit. But, you will only have a lawsuit if you have previously talked to this supervisor about your concern of not being on the schedule and they have not done anything. |

If you're getting paid the minimum salary and you've been in this situation for months, then it sounds like to me you're a freeloader who doesn't want to work. If you haven't received any income for months now, then I think that's called UNEMPLOYED!!!!! Get a JOB! |

Some of the answers you've gotten are far from reality.
Doesn't sound like you have any discrimination claim. Sounds like the library supervisor didn't like your "always constructive" comments and decided she didn't want you around. That's legal. |

Be sure that you haven't been "termed out" after 30 days. Many companies are now using that unsavory tactic. Also, you may want to file for unemployment benefits. It sounds as though you are eligible. Being on the payroll is useless if you are not getting any money to pay your bills and keep a roof over your head. Job discrimination is difficult to prove. I know because I am a female truck driver, and the discrimination that I deal with is unbelievable in this day and age. My gender and age are used against me. Good luck to you! Get proactive and file for unemployment, you can do it online. |

Hi,
Being on payroll and being paid are two separate things. If you are getting paid for no work - no worries. If you are on payroll (standby) but not getting paid, then you are free to look for other work. It is not job discrimination unless you are a minority and other non-minorities who are in the same situation with the same qualifications are getting the work. It can get complicated, so you should look at your options and consult an attorney if you believe you have a case against the company. Best Wishes! |

It would depend on what you feel discriminated against. If you're the only "different" one, possibly.
But, if you haven't worked in months, but your still on the payroll, I'd find a different job. Doesn't sound like it's something you're enjoying. |

lol. they want you to quit so they dont have to fire you...seriously you could not figure that out. you should use your time off to find another job. i dont know the reason that they dont want you to work there, but i doubt it is discrimination. |
