If off work sick, am I legally allowed to go to a second job?

I am off sick with work related stress. I am stressed out with my main job but i also have a part-time job that is part of my university degree. Am i allowed to go to this job if i am off sick from my first job? I am very happy with my placement job.

Legally yes,only because when you call out sick from most employers it has nothing to do with legality.(Unless its paid sick time)It's all pretty casual.Your manager usually just makes a note that you wont be there and calls in help if necessary.If someone sees you though,you could be in trouble.

what do you mean by 'legally allowed'?
if you are claiming pay from you employer or benifits from the state.
where are you? if uk, are you claiming Incapacity Benefit or similar.
there is a thing known as therapeutic work (allowed work) that is seen as helpful to your recovery. but you need to talk to the benefits people about what is allowed and what isn't.

You cannot be well for one job and ill for the other. Not sure which country you are in but if it is the UK you will presumably be claiming statutory sick pay and therefore any paid or unpaid work you do at the same time can be construed as defrauding the benefit system. As an employer if I found out you were working elsewhere while presenting sick notes to me I would seriously consider sacking you for gross misconduct and I would report you to the benefits agency. All that would look great on your CV when and if you get your degree!

if you are off sick and not well enough to go to your main job, then your not well enough to go to your second job. should your main employer find out, you can be sacked and you can do nothing about it. NO unfair dismissal, No tribunal nothing

It is not a question of "legality". No laws cover this type of problem (in the USA). If you are in another country, some labor laws prohibit you from even going out during the day except for doctor's appointments or necessary errands. It all depends on your areas labor laws.

If you are sick & cant go to work at first job, then you can not work at any other job. That is illegal . if of course you resign from the stressful job, then you can work at any other job.

You would be lying to your first employer as you have told them you are unable to work. That usually means any type of work not just the ones you cant be bothered to go to.

You are either stressed & unable to work, or you're not stressed, and simply don't like one job.

If you are fit enough to work, you should be attending your main job, but if you don't go there, but still attend your second job, you'll be in breach of the contract of employment.

Your best action is to decide whether you like your main job, and could cope with working there. If so, speak to your managers about your stress; otherwise, simply quit, and look for alternative work.

If your main employer pays you sick pay, you will be acting illegally, as this would include Statutory Sick Pay when clearly you are capable of working. If no sick pay, then simply a contractual breach, but not illegal per se.

If you are getting compensated for job number 1, then yes it is illegal. That's fraud!

I was faced buy the same problem at my work and when I spoke to my union rep he said yes you can be off sick but work somewhere else. I did my ankle in at work and should not have returned to my work when I did but I had just got a Job closer to home (with the same company) when I spoke to my union rep he told me I could have stayed off sick but started working at my new place and I was not fit to work at my old place of employment but well enuff to work at my new employment
