Is it legal for a company to have their employees use their vacation time when they are sick?

Is it legal for a company not to allow their employees any sick days, and make them use their vacation time if they should ever be sick? If not, who should be reported to fix the problem? This company actually asked if this person earned enough hours to go home early!

Companies don't have to give sick days. Your employer isn't your mother. They exist to make money, not to pamper you when you don't feel well.

The alternative would be for the employee to take the day off without pay.

Yes, this is legal. Sick days are something your compnay provides you as a courtesy. If you have used all your sick days then you have two choices. Take the day off unpaid or use a vacation day.

If there is an HR department, contact them. That's what they're there for. There should be an employee handbook that outlines policy in regards to taking time off (regardless of whether it is sick time, vacation, or otherwise). As far as I understand, an employer can't force vacation time. But I'm not sure. Contace your HR department.

Sick and/or vacation time is a gift from the employer and is not mandated by law. The employer doesn't have to give you any paid time off, by law.

Companies can make their own rules when it comes to sick and vacation time. However they can not deny someone from leaving early because they are sick or have a medical appointment. You can always take time off without pay.

I live in TX so things may be different in your state. Contact your local Workforce Commission.

If there is a union, ask the union. If not, go to the local authority office and get information/advice about employment law.

Legal- yes, a company doesn't have to give you any vacation time or sick time, it's a perk for working at that company. I don't know how they can -make- someone use their vacation time- why wouldnt they just dock their check? It's not like the person is losing anything, either they use the vacation pay and get paid for the time off or they don't and their check is short.

Depends where you live. In some cities or states, sick leave is mandatory, and is awarded depending on number of hours worked.

No. Sick days are to be used for that purpose. Any reputable company would allow their employees to use all of their sick time before dipping into their vacation time.

Vacation and sick time is a benefits that is not regulated by the government. In fact, they have no control if a company gives it to you at all. I would read over your company policies though and see if it states anywhere in there. If it does state anything about sick time then I would recommend taking that to the HR dept or the supervisor.

yes, the alternative being, if you are out of sick time, taking time unpaid. If the company does not allow for unpaid leave, then you must take your vacation time.

Your company can give you as many and as few sick or vacation days as they choose.

If you truly dislike it, you can find another job.

In my job I use my vacation days for sick days because at the end of the year I can "sell" or cash-in my remaining sick days. I cannot sell my vacation days.

not sure... I don't think it is required that employers provide you with sick or vacation time.. I think there are companies out there that in the instance that you are sick and have to miss work, they just take away pay for time missed. You might want to check with your states department of labor and industries or the better business bureau

Companies are not required to supply paid sick days. They ARE required (by law) to permit UNPAID sick days if they qualify under the FMLA.

If this company is THAT bad, your friend should never have chosen to work there in the first place. They tell you when they make you an offer how many sick and vacation days you get.

Yes, it's legal for a company to not allow employees to take unpaid time off. They can fire you for it if you do.

That said, if you are a good employee, most companies would work with you unless the time off became excessive. But they aren't required to, even if you're sick and can prove it.
