Is it legal in the state of TX for my boss to make me clock out and then tell me to continue working?

It's illegal anywhere to do that. Next time (even though difficult) say, "I can't keep working I jut clocked out, hold on a second I'll just clock back in."

If you do a google of working off the clock in TX, there are many hits. Many of them are for lawyers and the main culprit has been wall-mart.

It depends on how many times, the amount of time you work and not get paid. If occasional, for say 15 minutes, then even though not legal, most likely wont matter. But if you are working quite a few hours on a regular basis off the clock, then that is different. This could be a "grey area".

If they are asking you to work for a hour or 2 more, than you should stick to your guns and tell them you need to clock back in. Is it just you, or are other employees doing the same?

If he's doing it regularly (for example, asking you to clock out and then work an extra hour every day) then it's illegal and you can sue him. But if it's just once in a while he asks you to do something minor that only takes a minute or two then I wouldn't worry about it.

i think it mostly depends on the situation. if your boss constantly constantly does it then hell yeah its illegal. But if it's something really small that would take two minutes i think its better to just do the work and show better character than two minutes worth of pay. assuming its a small task. but if your boss is making you continue working again and again than it's not quite innocent.

why not just ask before you clock out if there's anything else they need you for.

No, that's not legal at all, especially if you're paid hourly. Next time, you can say, "I clocked out. I'll have to clock back in before I do that." If he argues, just repeat that you have clocked out and that your shift is over and then walk out, because you are off the clock.

Not only is he getting you to work for free, but if you were injured while doing that free work, it's likely a workman's compensation claim would be denied, since you wouldn't have been on the clock at that time.
