claiming compensation for falling at work/tescos?

I'm an a-level student working at tescos part time. we have a cardboard crusher machine at work and there is sometimes plastic and card lying around on the floor. i slipped on it and hurt my back and knee, it wasn't very serious, but i was in pain and couldn't walk properly for a few days. can i claim compensation for this, and would i get sacked for doing this? also how much would i get and how do i go about doing this?

they had to call an ambulance and i had an x-ray etc, i also had crutches for a few days. i missed a few days of work and a school. i cant really say about it effecting my grades as the school year just started a few days ago. can i not argue that it is unsafe to have that stuff lying around on the floor.

It can be a really long and complicated process to do this. Can I suggest you have a look at the PDF on the link below and then if you are still considering a claim, you will need to employ a solicitor and one which specialises in personal injury claims at work. You will also need to have filled in the accident record book at work.
If it's about the money then I'm afraid you will be disappointed. You would probably only get what you had lost in earnings, if any.
If you are concerned about health safety at work, you need to speak to your health and safety representative or your line manager about it. It is unsafe to have stuff laying around on the floor, but surely as adults, in an adult environment, each employee should be picking up the mess they make, in effect being responsible for their own and their colleagues health a safety.

At the time you were injured and taken to the doctor/hospital did you tell the doctor how you got hurt? They would have filed a claim for workers comp. benefits to pay for the medical claims for you at that time. As far as getting money for it? That would be up to your doctor if there is permanent damage to your back or knee.

Do you have a contract? do you pay NI contributions or is it cash in hand? Try to no win no fees lawyers, hubby had similar accident and claimed, he got few thousand for it and didn't loose his job, if you work cash in hand there is nothing you can do.

tescos is a massive company so they will be used to people sueing them i wouldnt worry about the sack
talk to your boss and say you slipped and it affected your a-levels cos you had to miss a day or two (make it up if you need to haha) then they wouldnt want to go through cought so may just give you a bit of cash to keep it simple
usualy the legal fee's woul be more than you could claim for something like this though unless you called up one of those injury loyers 4 u things or something, they dont charge you unless they get you some money

What Mike H said about injury lawyers is not true. If you win you don't need to pay them because they claim all expenses from the other side. If you lose you don't pay your lawyer because of a no win no fee basis ( if that's what you done) but you will have to pay for the other sides expenses.

First off make sure you have had the accident wrote in the RP555 accident book.both sides of the page as you work there. then see your personnel and ask for a claims form. make sure you keep a copy and then send it off to the claims Dept Glasgow, your personnel will give you all the info, if you are a union member see your rep,

Please, make a claim, you do not know how this injury can affect you in your later years.
It is not your responsibility to ensure that an accident record was kept, if an ambulance was called to the premises they should have a record of why and what for. If they didn't that is in your favour as its legal that they should have.
You can make a claim, and as your under 18 Tesco's should have specific documentation about any training you have received risk assessments etc which you should have been made aware of during your employment with them. i would personally look up a no win no fee solicitor and get some advise (as i presume you are not in a union), regarding your paticular accident, You can expect to receive any lost earnings for the time you were off sick any money paid out of your pocket for travelling to and from hospital visits doctors etc and a compensation payment for any pain you had which prevented you from doing your normal day to day routine.
Bear in mind no win no fee solicitors may take a percentage of your compensation payout so ring around and ask beforehand just how much of a percentage, before you go and see them.

Never be afraid to make a claim due to an injury at work. Employers hope people feel that way, but don't. You have to make a report with your employer. Your employer is supposed to make a report as soon as you are injured and you are supposed to tell someone at work. Such as your supervisor about the injury. You went to emergency and you should of told them there it was work related. Then they send a form to WSIB. WSIB will send you a letter and some forms for you to fill out. It does not matter how serious this injury was, just make sure you have all the dates and times and any names of witness. I would call the Workers Safety and Insurance Board and talk to someone if you have not already done what I suggested. I know alot about injuries
as I belong to a group that helps people who are injured.

You could try but it's unlikely you'll get far. For a start your GP will have to agree that your injury was serious.

A personal injury claim would need to show a long term deficit in terms of your health and also a financial loss to have any chance of succeeding.

While it is technically unlawful for an employer to take action against someone for making a claim, they can dismiss on the grounds of incapability even if a claim is being pursued.

You should also be aware that submitting a weak case to the court could result in a counter claim against you for being frivolous and vexatious!

The chances are that you wouldn`t get much, if anything, from what you say.

If however the injuries became worse overtime [you have 3 years to claim in the UK] then you could claim then..

The main loss you get for this sort of thing is for loss of earnings, unless you have had a serious injury.

You will find `no-win, no fee` lawyers who will speak to you for a chat at no cost but don`t expect too much as it stands.

You may find that you will not get anything! You should appreciate that any employee has a 'duty of care'.

As cardboard and plastic on the floor obviously presents a hazard i would have to ask the question, why did you not pick it up? Had you picked it up you would not have slipped on it would you, so basically, you are at least partly to blame for the accident yourself !
